ORDINANCE NO. 2988
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF ECC
4.90.070 RELATING TO THE LICENSE FEE FOR
COMMUNITY ORIENTED OPEN AIR MARKETS TO
REDUCE SUCH FEES AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City had previously enacted ECC Chapter 4.90 in order to
provide for a test period during July, August and September of 1994 to review community
oriented open air markets, the permitting criteria established by the chapter and the fees to be
charged, and
WHEREAS, the charitable entity proposing to conduct a community oriented open
air market has requested a reduction in the fees during the test period asserting that the fees
established by the current ordinance will be prohibitive and limit usage of the market, thereby
depriving the City of this amenity and the City Council of a reasonable opportunity to review
the use in light of an adequate trial period, and
WHEREAS, the City Council deems it appropriate to reduce such fees recognizing
that at the existing and proposed levels there will be significant subsidy of the permitted
activities through public funds due to unrecovered inspection and permitting costs, but that such
subsidy is an appropriate use of public funds in that enhances tourism and provides a test period
upon which future zoning activity and regulation may be based, NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 4.90.070 License Fee of the Edmonds Community
Development Code is hereby amended to read as follows:
4.90.070 License Fee. An applicant for a license to operate a
community oriented open air market shall pay a fifty dollar
($50.00) fee. This fee is based upon the cost to the City of
reviewing and processing the application and shall be submitted in
conjunction with the application. Each participating vendor shall
pay five dollars ($5.00) for its participation in the community
oriented open air market during the 1994 trial period. No
application shall be deemed complete until all fees have been paid.
Section 2. Effective Date. This ordinance is subject to referendum and shall take
effect and be in full force thirty (30) days after final passage and after publication of an
approved summary thereof consisting of the title.
