Ordinance 1910ORDINANCE NO. 1910 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REPEALING ORDINANCE NO. 1428 PASSED BY THE CITY COUNCIL JULY 1, 1969, DECLARING RIGHT-OF-WAY AS SURPLUS PROPERTY, AUTHORIZING THE SALE OF EXCESS RIGHT-OF-WAY ACQUIRED, AUTHORIZING TRANSFER OF FUNDS FROM LID GUARANTY FUND NO. 613 TO STREET ARTERIAL FUND NO. 112, AND DIRECTING THE PLACE- MENT OF MONIES ACQUIRED BY SALE. WHEREAS, the City Council of the City of Edmonds in Ordinance No. 1428, passed by the Council on July 1, 1969, ordered the improvement of certain property in the vicinity of 198th Street Southwest and Seventy-seventh Avenue West by means of installing curbs, gutters, sidewalks, and other im- provements, and WHEREAS, at this time the construction of these improve- ments is no longer necessary or feasible, and WHEREAS, it is in the best interests of the City of Edmonds and the citizens thereof that all rights -of -way ac- quired by the City in connection with the anticipated con- struction be sold, and WHEREAS, the costs of acquiring the rights -of -way, in- cluding appraisal, recording fees, publication costs, and interest, should be repaid immediately to the Street Ar- terial Fund No. 112 from the LID Guaranty Fund No. 613 with proceeds of sale of the excess right-of-way to be paid into the LID Guaranty Fund No. 613, now, therefore THE CITY COUNCIL OF THE CITY OF EDMONDS DO ORDAIN AS FOLLOWS: -1- Section 1. Ordinance No. 1428 passed by the City Council on July 1, 1969, is hereby repealed. Section 2. The City Council hereby finds that all rights -of -way acquired by the City for the construction of the improvements ordered by the terms of Ordinance No. 1428 are surplus, and said rights -of -way are authorized to be sold in the manner set forth by law. Section 3. The Finance Director is hereby authorized and directed to make all necessary entries and transfers to transfer the sum of $5,938.10 from LID Guaranty Fund No. 613 to the Street Arterial Fund No. 112 to repay loans from said Fund No. 112 to LID 176. Section 4. All monies acquired from said sale of ex- cess right-of-way shall be paid into LID Guaranty Fund No. 613. APPROVED: MAYOR, H. H.
