AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
ADDING A NEW SUBSECTION 12.10.150(e) TO THE
EDMONDS CITY CODE PROVIDING FOR DIRECT REVIEW OF
SHORT SUBDIVISION APPLICATIONS BY THE PLANNING
COMMISSION.
WHEREAS, there are occasions where staff review
hearings of short subdivision applications would not be
proper due to special circumstances of the applications; and
WHEREAS, in such circumstances the staff review
hearing should be eliminated and the matter decided directly
by the Planning Commission; and
WHEREAS, there are no adverse environmental impacts
as a result of this proposed change; now, therefore
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. A new subsection 12.10.150(e) is hereby
added to the Edmonds City Code to read as follows:
"12.10.150(2)(e). Direct Review by Planning Commission.
If the City Planner determines that a staff review
hearing would not be proper because of actual or
apparent conflicts of interest or the possibility
the staff review hearing may not have the appearance
of fairness, the City Planner may refer the applica-
tion directly to the Planning Commission. The City
Planner shall place in the file a brief written state-
ment of the reasons why the matter is being referred
to the Planning Commission.
Notice of the City Planner's decision to invoke
direct review of the application by the Planning
Commission shall be sent to the applicant. Notifica-
tion of the date, time and place of the Planning
Commission hearing shall be posted and mailed as
provided in Section 12.10.150(2)(b) of the Edmonds
City Code.
