Ordinance 1940ORDINANCE NO. 1940 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADDING A NEW SECTION 5.25.030 TO THE EDMONDS CITY CODE PROHIBI- TING THE CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES AND PROHIBITING POSSESSION OF OPEN OR UNSEALED CONTAINERS OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES AND PROVIDING PENALTIES. WHEREAS, the following addition to the Edmonds Criminal Code is necessary for the public health, safety and general welfare, now, therefore THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Section 5.25.030 is hereby added to the Edmonds City Code to read as follows: "5.25.030 Alcoholic Beverages Prohibited in Public Places It shall be unlawful for any person to consume any al- coholic beverage in a public place or possess an open or unsealed container of any alcoholic beverage in a public place. A person shall be deemed to be in a pub- lic place if occupying a vehicle parked or traveling on a public place. For the purposes of this section, a public place shall mean all places to which the general public has access, including stores, theaters, restaurants, parking lots, parks, school yards, beaches, streets and rights -of -way. Provided, however, this section shall not apply to locations licensed by the State of Washington to sell alcoholic beverages for consumption on such premises. Section 2. Any person convicted of violating the pro- visions of Section 1 of this Ordinance shall be subject to the penalties set forth in Section 5.45.020 of the Edmonds City Code.
