Ordinance 1942ORDINANCE NO. 1942 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING VARIOUS SECTIONS IN CHAPTER 6.16 OF THE EDMONDS CITY CODE; INCREASING THE TURN-ON/TURN-OFF CHARGES; INCREASING THE DEPOSIT REQUIREMENT; AND ALLOWING REFUND OF DEPOSITS. WHEREAS, the present turn-on/turn-off charges imposed by the Water Department do not adequately compensate the Department for the actual costs involved in such operations, and WHEREAS, the present $15.00 deposit falls short of the minimum billing for a bimonthly billing and should be increased, and WHEREAS, such deposit should be returned to the cus- tomer when adequate credit has been established, now, there- fore, THE CITY COUNCIL.OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 6.16.060 of the Edmonds City Code is hereby amended to read as follows: "6.16.060 Accounts --Payments. All accounts shall be kept on the books of the Water Department in the name of the owner, or his authorized agent or lessee, and all charges shall be made against the property as well as the owner thereof. No change of ownership or occupancy shall affect the application of this Section. All bills are payable within ten days from the billing date. Flat rates are payable in advance. If water bills are not paid within a stated period, the water may be shut off. Water will be turned on after payment of the fees as set forth in Section 6.16.165 of the Edmonds City Code, in addition to the amount of delinquent charges." Page one Section 2. Section 6.16.120(B), of the Edmonds City Code is hereby amended to read as follows: "6.16.120(B) Should the customer desire to discontinue the use of water 7or any period of less than thirty days, written notice thereof must be given to the Water Department. The customer shall be required to pay the charges as set forth in Section 6.16.165 of the Edmonds City Code." Section 3. Section 6.16.150 of the Edmonds City Code is hereby amended to read as follows: "6.16.150 Limitation on Water Use. The City Council may, in the case of shortage of water, or for any other reasonable cause, pass a resolution forbidding or limiting the use of water in said city, or in any portion thereof, for irrigation or sprinkling purposes, and may, at its discretion, make such order at any time. Notice of such resolution shall be given by publication in the official newspaper of the city, not less than one day before the effective date of such resolution. In the event of a violation of any such resolution the water may be turned off from the premises, and the same shall not be turned on again until the owner or occupant of the premises shall have paid to the Water Department the charges as set forth in Section 6.16.165 of the Edmonds City Code." Section 4. Section 6.16.180 of the Edmonds City Code is hereby amended to read as follows: "6.16.180 Deposit --Refund. When an application is made to the Water Department for the domestic use of water by any person other than an owner or purchaser of the premises for which the water will be used, such as a renter, lessee or tenant of said premises, said applicant shall be required to make a $25.00 deposit with the Water Department. If there have been no delinquencies in the account for a period of one year, the Water Department shall refund the deposit to the customer. Provided, however, the Water Department may require the customer to make a $25.00 deposit if a delinquency occurs subsequent to the refund of the deposit." Section 5. A new Section 6.16.165 is hereby added to the Edmonds City Code to read as follows: Page two "6.16.165 Turn on/off Charges. The charge for turning on or turning off the water shall be $10.00. If the water is turned on or turned off at any time other than regular working hours (8:00 a.m. to 5:00 p.m.), on weekends or on any holiday, the charge shall be $15.00.
