ORDINANCE NO. 2177
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 3.20.170 OF THE
EDMONDS CITY CODE TO INCLUDE LIABILITY FOR
COSTS OF ABATING NUISANCES AND PROVIDING
PROCEDURES FOR COLLECTION THEREOF; AND
REPEALING SECTIONS 3.20.130 AND 3.20.140
OF THE EDMONDS CITY CODE DEALING WITH
COURT -ORDERED ABATEMENTS AND CONTINUING
NUISANCES.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 3.20.170 of the Edmonds City Code
is hereby amended and renumbered as 6.20.150 to read as
follows:
6.20.150 LIABILITY FOR ABATEMENT EXPENSES
A. Every person guilty of any nuisance shall be
liable for all costs and expenses of abating the
same and, when such nuisances have been removed by
any city officer, the said costs and expenses
shall be taxed as a part of the costs of any
prosecution against the party liable and be re-
covered as other costs are recovered after the
same shall have been ascertained when done by the
city under the authority of the chief of police.
B. In all cases where the chief of police or other
officer shall abate any nuisance, he shall keep an
account of all expenses attending such abatement.
C. To collect such costs and expenses, the police
chief may refer the matter to the city attorney
for appropriate action including instituting suit
for collection in any court of competent juris-
diction in the name of the City of Edmonds against
the person creating or keeping or maintaining the
nuisance so abated.
Section 2. Sections 3.20.130 and 3.20.140 of the
Edmonds City Code dealing with court -ordered abatement and
continuing nuisances are hereby repealed.
Section 3. This ordinance will be in full force and
effect five (5) days after passage and publication by post-
ing as provided by law.
