Ordinance 2184WDT/trs 12/9/80 ORDINANCE NO. 2184 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, AUTHORIZING THE FILING OF TRAFFIC VIOLATIONS, TRAFFIC INFRACTIONS AND CRIMINAL CITATIONS IN THE SOUTH DISTRICT COURT AND DECLARING AN EMERGENCY. WHEREAS, in 1975 by Ordinance No. 1746 the City established the Edmonds Municipal Court pursuant to RCW 35A.20, and WHEREAS, since that time the City has been filing its traffic and criminal cases in the Edmonds Municipal Court, and WHEREAS, the Court of Appeals in State ex rel. Farmer v. Edmonds Municipal Court has ruled that the City did not have authority to establish the Edmonds Municipal Court under 35A.20 but instead must proceed within the Justice Court Act, RCW 3.30-3.74, and WHEREAS, pending the filing of motions to recon- s"der with the Court of Appeals, any petitions for review to the Supreme Court, and final Supreme Court decision, it is necessary for the orderly administration of justice that the prosecution of violations of Edmonds ordinances continue if the Court of Appeals decision is not reversed, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City of Edmonds is authorized to file traffic violations, traffic infractions and criminal cases in the South District Court and/or the Edmonds municipal department of the South District Court, if such a department is formed, and the municipal court may also transfer pending cases to the South District Court. Nothing herein shall be deemed to prohibit the City from filing any cases in the Edmonds Municipal Court. Section 2. The City Council finds that unless the above steps set forth in Section 1 of this ordinance are taken, the City's ability to prosecute violations of its ordinances will be greatly diminished and will result in harm to the public safety, health, peace and general welfare. The City Council finds that this is a public emergency ordinance, necessary for the protection of the public health, public safety and the public peace and shall be effective immediately upon passage by a vote of a majority plus one of the whole membership of the Council.
