Ordinance 2252MAE/lac 12/17/81 ORDINANCE NO. 2252 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, RELATING TO OFF-STREET PARKING IN DOWNTOWN EDMONDS AMENDING SECTION 17.50.040 OF THE COMMUNITY DEVELOPMENT CODE EXTENDING THE AREA IN WHICH THE OFF-STREET PARKING REQUIRED FOR A PARTICULAR USE MUST BE LOCATED, AND SECTION 15.00.030B OF THE COMMUNITY DEVELOPMENT CODE RAISING THE FEES PAID IN LIEU OF PROVIDING OFF-STREET PARK- ING AND DECLARING A PUBLIC EMERGENCY. WHEREAS, the City Council passed an ordinance in December of 1980, which established the requirement that off-street parking be located within 300 feet walking distance of the use for which such parking is required, and WHEREAS, the City Council finds that in the Downtown Business Area, it is often difficult for an applicant to provide the required off-street parking within 300 feet of the proposed use due to the scarcity and high value of land suitable for off-street parking and that such policy may frustrate efforts to provide off-street parking, and WHEREAS, the City Council further finds that the policy of providing adequate off-street parking for the com- mercial district of downtown Edmonds would be equally well served by providing that required off-street parking spaces be acquired and constructed anywhere within the area of down- town Edmonds zoned Commercial Business (BC), and WHEREAS, the City of Edmonds established an off- street parking fund by Ordinance No. 1914 in 1977 and permitted, in certain circumstances that an applicant could provide a portion or all of the parking spaces required under the code by paying a fee of $1000.00 per parking space (or $500.00 if a remodel is proposed) in lieu of actually acquir- ing and constructing such parking spaces, and WHEREAS, the fee paid in lieu of providing parking spaces has not changed since 1977, and WHEREAS, the City Council finds that the actual cost of providing parking spaces has substantially increased, now costing up to an average of $6,500.00 per parking stall, and WHEREAS, the City Council finds that the fee paid in lieu of providing actual parking spaces is grossly insuffi- cient and no longer achieves the policy behind the in lieu of parking concept, and WHEREAS, the City Council further finds that there is a substantial danger that the disparity between what an applicant is required to pay in lieu of providing parking spaces and what that applicant would pay to actually provide those parking spaces may cause substantial harm to public property by way of depleting the resources available for insuring that adequate off-street parking exists in downtown Edmonds, and WHEREAS, the City Council therefore finds that the inequities described above constitute a public emergency requiring the protection of public property and therefore determine that the in lieu of parking fees should be -2- increased and that this ordinance should take effect immedi- ately upon passage, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Edmonds Community Development Code Section 17.50.040 is hereby amended to extend the area for locating off-street parking to include the entire BC zone as follows: "17.50.040 LOCATION A. Permitted Uses in Residential Zones. Off-street parking shall be located on the same lot and within 100 feet walking distance of the use for which it is required. B. All Other Uses. Off-street parking shall be located within 300 feet walking distance of the use for which it is required, except that the only requirement for the location of off-street parking required for a use in the Downtown Business Area shall be that such parking be located within the Downtown Business Area that is zoned for Commercial Business (BC). If the off-street parking is not on the same lot as the use for which it is re- quired, the owner or lessor shall provide to the City for recording with the County Auditor an agreement specifying: 1. The location, by legal description or survey, of the off-street parking and the use for which it is required. 2. A restriction on the property designated for off- street parking that it may not be used for any other purpose unless the parking is no longer required for the use specified in 1. above." Section 2. Edmonds Community Development Code Section 15.00.030B is hereby amended to increase the in lieu of parking fee as follows: -3- "15.00.030 OTHER FEES B. Parking (in -lieu fee): New construction, $4,300 per space; Conversions, $2,100 per space" Section 3. This ordinance being a public emergency ordinance and having been passed by at least a majority plus one of the whole Council shall be effective upon adoption. APPROVED: MAYOR, N."H.
