ORDINANCE NO. 2270
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 20.05.020(C) OF
THE COMMUNITY DEVELOPMENT CODE DELETING
THE REQUIREMENT THAT THE HEARING EXAMINER
APPROVE EXTENSIONS OF TIME FOR ACTION
UNDER A CONDITIONAL USE PERMIT.
WHEREAS, the City Council finds that there is a
procedural conflict in Section 20.05.020 of the Edmonds
Community Development Code wherein Subsection C directs that
the Hearing Examiner approve an application for the extension
of the one year period during which a conditional use permit
applicant must act under such permit, and Subsection D where
the same application for extension of time is to be reviewed
only by the Community Development Director pursuant to the
procedures of Section 20.95.050, and
WHEREAS, the City Council finds that requests for
extensions should be heard by the Community Development
Director, and
WHEREAS, Section 20.05.020(C) is potentially ambig-
uous with regard to when such permit would expire and
requires clarification, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 20.05.020(C) of the Community
Development Code is hereby amended to read as follows:
C. Time Limit. Unless the owner obtains a building
permit, or if no building permit is required, sub-
stantially commences the use allowed within one

year from the date of approval, the conditional use
permit shall expire and be null and void, unless
the owner files an application for an extension of
the time before the expiration date.
Section 2. This ordinance shall be in full force
shall be in full force and effect five days after passage and
publication by posting as provided by law.
