ORDINANCE NO. 2291
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTION 17.00.020(d) OF
THE EDMONDS CITY CODE AND ADDING A NEW
SUBSECTION (e) PROVIDING THAT ANNEXED LAND
WHICH IS NOT ZONED SIMULTANEOUSLY WITH SUCH
ANNEXATION SHALL BE CONSIDERED TO HAVE THE
ZONING CLASSIFICATION CLOSEST TO PRIOR
COUNTY ZONING.
WHEREAS, the City Council finds that it is necessary
in the public interest to provide for an alternative to
simultaneous zoning of land proposed for annexation to the
City when the appropriate zoning classification cannot be
determined within the normal time frame of an annexation
proceeding, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 17.00.020(d) is hereby amended
to read as follows:
(d) Unclassified Land. All lands not classified
according to the established district classifi-
cations on the official zoning map shall be
classified as RS-12, pending study, public
hearing and specific classifications.
Section 2. A new subsection (e) is hereby added to
Section 17.00.020 of the Community Development Code to read
as follows:
(e) Annexed Land. The zoning classification of all
land annexed to the City shall be determined at
the time of annexation and after two public
hearings held at least thirty days apart as
required by state law, except when the
appropriate zoning cannot be determined without
further study and/or public comment. All land
annexed to the City and not simultaneously
zoned shall be considered tentatively as having
a zoning classification that is the nearest and
most similar to the classification such prop-
erty enjoyed under county zoning, pending
study, public hearing and specific classifi-
cations.
Section 3. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
