ORDINANCE NO. 2295
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, ADDING A NEW SUBSECTION D TO SECTION
5.21.010 OF THE EDMONDS CITY CODE PROVIDING
A DEFINITION OF "PUBLIC OFFICER" FOR THE
PURPOSES OF THE CRIME OF OBSTRUCTING A PUB-
LIC OFFICER.
WHEREAS, the Edmonds City Code currently defines
"Public officer" in Section 5.12.040N to include any person
who performs a public function and thereby exercises some of
the sovereign power of government and includes all assistants
of a public officer, and the City Council desires to amend
the definition of public officer for the purposes only of the
crime of obstructing a public officer, now, therefore
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A new subsection D is hereby added to
Section 5.21.010 of the Edmonds City Code providing a defini-
tion of "public officer" for the limited purpose of defining
the crime of "obstructing a public officer" to read as
follows:
D. Public Officer Defined. For the purposes of
this section only, "public officer" means a
person holding an office under a city, county,
state or federal government who performs a
public function, is thereby charged with
promoting public health, safety and general
welfare, and thereby exercises a sovereign
governmental power and includes any lawful
delegee or deputy of such officer.
Section 2. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
