Ordinance 2298MAE/lc 5/11/82 ORDINANCE NO. 2298 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, AMENDING ORDINANCE NO. 2200 PASSED BY THE CITY COUNCIL ON MARCH 3, 1981 CREAT- ING LOCAL IMPROVEMENT DISTRICT NO. 209 AND PROVIDING FOR THE CONSTRUCTION OF A WATER LINE AND FIRE HYDRANT AS AN ADDITIONAL IMPROVEMENT TO SAID DISTRICT AND, FURTHER- MORE, AMENDING THE ESTIMATED COST OF SAID LOCAL IMPROVEMENT DISTRICT. WHEREAS, the City Council of the City of Edmonds, Washington, passed Ordinance No. 2200 on March 3, 1981 there- by creating a local improvement district ordering the improvement of certain property in the City of Edmonds by paving the street with an asphalt overlay, installing neces- sary drainage, and performing any necessary grading, base preparation and related work to make a complete improvement in accordance with City standards, and WHEREAS, the owners of all property situated within said local improvement district, that will receive benefit from such improvements, and which will be subject to special assessments have requested that the construction of a water line and fire hydrant be added to such local improvement district and, furthermore, such owners have agreed that the cost of said additional improvement will be added to the assessment against each piece of property in the same ratio as the costs of the original improvements would be distributed, and WHEREAS, the estimated cost of such additional improvement will be $10,000, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 1 of Ordinance No. 2200 passed by the City Council on March 3, 1981 is hereby amended to read as follows: The following property within the City of Edmonds, Washington, is hereby ordered to be improved by paving the street with an asphalt overlay, instal- ling necessary drainage and performing any neces- sary grading or base preparation, installing water line and fire hydrant and related work necessary to make a complete improvement in accordance with City standards, said street being an extension of Cyprus Place as set forth on Exhibit "A" attached hereto and incorporated in full by this reference. Section 2. Section 4 of Ordinance No. 2200 is hereby amended to read as follows: The estimated cost and expense of the said im- provement is hereby declared to be $51,500.00. The entire cost and expense of said improvement, including all labor and materials required to make a complete improvement, all engineering, survey- ing, legal, inspection, ascertaining ownership of the lots or parcels of land included in the assessment district, advertising, mailing and publication of notices, accounting, administra- tive, printing, costs of acquisition and other expenses incidental thereto, shall be borne by and assessed against the property specially benefited by such improvement included in the local improve- ment district established, embracing as near as may be, all property specially benefited by such improvement, PROVIDED, further, that at the time fixed for hearing objections to the confirmation of the assessment roll, and at times to which the hearing may be adjourned, the Council may correct, revise, raise, lower, change or modify the roll or any part thereof, or set aside the roll and order the assessment to be made de novo and at the con- clusion thereof confirm the roll by ordinance. -2- Section 3. The remaining portions of Ordinance No. 2200 shall not be affected by this ordinance and shall continue to be in full force and effect. Section 4.
