ORDINANCE NO. 2305
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, AMENDING SECTIONS 3.20.050 AND
7.30.030G OF THE EDMONDS CITY CODE REDUCING
THE RATE AT WHICH ELECTRIC, NATURAL GAS,
WATER AND TELEPHONE UTILITIES ARE TAXED OR
SURCHARGED AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the state legislature passed Engrossed
Senate Bill No. 4972 in the 1982 First Special Session
requiring the eventual reduction of utility rates on elec-
trical energy, natural gas or telephone businesses to a level
not to exceed 6 percent, and
WHEREAS, the City Council finds that it is in the
best interests of the City of Edmonds and its citizens to
reduce the taxes on electrical energy, natural gas and tele-
phone utilities and the surcharge on water utility, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 3.20.050 of the Edmonds City
Code is hereby amended to read as follows:
3.20.050 OCCUPATIONS SUBJECT TO TAX - AMOUNTS
Sellers of electricity, gas, water and telephone
services shall be subject to the tax imposed by this
chapter. There are levied upon and shall be col-
lected from every person, firm, corporation or other
entity on account of the business activities, license
and occupation taxes in the amount to be determined
by the application of the rates against gross income,
as follows:
A. Public utility districts. Upon every person,
firm corporation or other entity engaged in or
carrying on the business of selling or furnishing
electrical energy and power, a fee or tax equal
to 6 percent of the total gross income from such
business within the City of Edmonds during the
tax year for which the license is required; pro-
viding, however, that there shall be no tax or
fee from revenues derived from the sale of elec-
tricity for purposes of resale.
B. Natural or manufactured gas and service. Upon
every person, firm corporation or other entity
engaged in or carrying on the business of trans-
mitting, distributing, selling and furnishing
natural and/or manufactured gas, a tax equal to 6
percent of the total gross income from the sale
of gas within the corporate limits of the City
during and for the term for which the occupation
license is required.
C. Reserved.
D. Telephone Business. A tax equal to 6 percent of
the gross subscribers' exchange monthly service
charges billed to business and residence cus-
tomers located within the corporate limits of the
City, together with 6 percent of gross income
derived from intrastate toll service provided to
business and residential customers located within
the corporate limits of the City.
Section 2. Section 7.30.030G of the Edmonds City
Code is hereby amended to read as follows:
G. Consumption Surcharge. All customers shall pay
an additional surcharge in the amount of 6 per-
cent of the base rate and variable rate for
water as set forth in subsections A and B of
this section.
Section 3. If any portion of this ordinance is held
to be invalid for any reason such invalidity shall not affect
the validity of any other portion of this ordinance.

Section 4. This ordinance shall be in full force
and effect on July 1, 1982.
