Ordinance 2317MAE:lc 8/17/82 ORDINANCE NO. 2317 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, AMENDING SECTIONS 2.40.010 AND .020 OF THE EDMONDS CITY CODE REGARDING BONDS OF OFFICERS AND REPEALING SECTION 2.40.040 REGARDING THE AMOUNT OF SUCH BONDS. WHEREAS, it is necessary to amend Chapter 2.40 of the Edmonds City Code so as to be consistent with RCW 35A.12.080 and RCW 35A.42.020 by authorizing blanket bonding and requiring approval of the Mayor, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 2.40.010 of the Edmonds City Code is hereby amended to read as follows: 2.40.010 Bonds Required --Amounts, Blanket Bond Authorized The Finance Director, City Clerk, Deputy City Clerk, Chief of Police and City Attorney shall be bonded and may be so bonded by an individual bond policy or by a blanket bond policy including other city employees, naming the City of Edmonds as its beneficiary and bonding all covered officers and employees for Five Thousand Dollars ($5,000.00) or more for fidelity, for Five Thousand Dollars ($5,000.00) or more for faithful performance, and for Twenty-five Thousand Dollars ($25,000.00) or more as an aggregate excess fidelity coverage. The surety for such bond shall be a surety company authorized to do business in the State of Washing- ton, or an unauthorized surety insurer as a sur- plus line pursuant to Chapter 48.15 RCW. Any such bond offered in satisfaction of this section must be approved by the Mayor. Section 2. Section 2.40.020 of the Edmonds City Code is hereby amended to read as follows: 2.40.020 Premium Payments The premiums of bonds meeting the requirements of this chapter shall be paid by the City of Edmonds. Section 3. Section 2.40.040 of the Edmonds City Code relating to the bond amounts of certain officers is hereby repealed. Section 4. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the valid- ity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 5. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 6. This ordinance shall be in full force and effect five days after passage and publication by posting as provided by law.
