Ordinance 2337MAE:lc 11/9/82 ORDINANCE NO. 2337 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, ADDING A NEW SUBSECTION C TO SECTION 5.43.100 OF THE EDMONDS CITY CODE PROHIBITING THE CASTING OF FISHING TACKLE FROM CERTAIN PORTIONS OF THE FISHING PIER; DIRECTING THAT SIGNS BE POSTED; AND ADDING A NEW SUBSECTION 7 TO SECTION 5.45.020E PROVIDING FOR A FINE ONLY AS THE PENALTY FOR VIOLATIONS OF FISHING PIER REGULATIONS. WHEREAS, users of the Edmonds Public Fishing Pier at the Edmonds Boat Harbor adjacent to the Dayton Beach Park have been casting fishing lines and hooks onto nearby boats thereby causing damage and pulling equipment into the water, and WHEREAS, the City Council finds that it is in the best interests of public health and general welfare that casting on the Edmonds Fishing Pier be restricted so that such activity does not interfere with nearby boats, and WHEREAS, the City Council finds that offenses of this nature should be punishable by a fine only without the possibility of a jail sentence, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. There is hereby added a new subsection "C" to Section 5.43.100 of the Edmonds City Code to read as follows: C. No person shall cast fishing tackle of any kind or description, including but not limited to, hooks, lines and/or sinkers, from the fishing pier at any location where signs are posted to prohibit such casting. Section 2. The Director of the Parks and Recreation Department is hereby instructed to post signs on the Edmonds Fishing Pier in conspicuous locations prohibiting the casting of fishing tackle where there is a reasonable likelihood that such tackle will reach any boat which is moored in compliance with moorage regulations of the Port of Edmonds and/or the City of Edmonds. Section 3. Section 5.45.020E of the Edmonds City Code is hereby amended by adding a new subsection 7 making such offenses punishable by a fine only to read as follows: 7. Section 5.43.100, Fishing Pier Regulations. Section 4. If any section, sentence, clause, phrase or word of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the valid- ity or constitutionality of any other section, sentence, clause, phrase or word of this ordinance. Section 5. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law. APPROVED: -.11 7d �<.
