Ordinance 2370MAE:jt 5/31/83 ORDINANCE NO. 2370 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADDING A NEW SECTION 4.12.065 TO THE EDMONDS CITY CODE IMPOSING TIME AND PLACE RESTRICTIONS ON SOLICITOR'S LICENSES. WHEREAS, the City of Edmonds regulates peddlers, solicitors and concessionaires as defined by Chapter 4.12 of the Edmonds City Code for the purpose of protecting the public health, safety and welfare, and WHEREAS, the Fourth of July fireworks display has generated large amounts of automobile and pedestrian traffic in the immediate vicinity of the official fireworks display, and WHEREAS, the City Council finds that limiting the location of concessions to the fireworks display viewing area as designated by the Chief of Police is a necessary means of controlling such traffic, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Section 4.12.065 is hereby added to the Edmonds City Code to read as follows: 4.12.065 SOLICITING RESTRICTIONS All licenses issued pursuant to this chapter shall be subject to the following time and location restrictions: A. Fourth of July fireworks display - for the purpose of crowd and traffic control on the Fourth of July, all soliciting after six p.m. within one mile of the official fireworks display shall take place only within the confines of the fireworks viewing area as designated by the Chief of Police on the Civic Center playfield. Section 2. The Chief of Police is hereby directed to designate the boundaries of the official fireworks display viewing area and post notices stating that all solicitors and concessions shall be located within such boundaries after six p.m. on July 4th. Section 3. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitu- tional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitu- tionality of any other section, sentence, clause or phrase of this ordinance. section 4. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law.
