Ordinance 2373WDT:jt 6/13/83 ORDINANCE N0. 2373 AN ORDINANCE OF THE CITY OF EDMONDS, WASHING - TON, ADDING A NEW SECTION 8.32.025 TO THE EDMONDS CITY CODE AUTHORIZING THE TRAFFIC ENGINEER TO ERECT SIGNS PROHIBITING PERSONS FROM THROWING, BATTING OR CATCHING ANY BALL OR OTHER OBJECT ON CERTAIN CITY STREETS AND PROVIDING PENALTIES. WHEREAS, the City Council of the City of Edmonds finds that playing in city streets presents a potential safety hazard in certain areas of the City and the following amend- ment is in the best interest of the public health, safety and general welfare, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Section 8.32.025 is hereby added to the Edmonds City Code to read as follows: 8.32.025 PLAYING IN STREETS PROHIBITED A. When adequate signs have been posted, no person shall play in the public street by means of throwing, batting or catching any ball or other object. B. The traffic engineer is authorized to erect signs prohibiting the conduct specified in subparagraph A of this section along those streets or portions of streets where appropriate, considering the following factors: 1. The number of vehicles using the street or portion of the street. 2. The speed of vehicles utilizing the street. 3. The width of the street. 4. The time of day the street has been utilized for play. 5. The number of people using the street for play. 6. The danger of accidents occurring as a result of play in the streets. Section 2. Any person violating any provision of this ordinance shall be deemed to have committed a misdemeanor and shall be punished solely by a fine in a sum not exceeding $500 and shall not be subject to imprisonment. Section 3. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitu- tional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or con- stitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law. APPROVED: MAYOR, H. .
