Ordinance 2378MAE:jt 6/22/83 ORDINANCE NO. 2378 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, VACATING CERTAIN PROPERTY IN THE CITY OF EDMONDS, WASHINGTON DEDICATED FOR STREET PURPOSES BEING A PORTION OF AN ALLEY EAST OF SEVENTH AVENUE, SOUTH OF FIR STREET, NORTH OF ELM STREET AND WEST OF B AVENUE; CITY FILE DESIGNATION ST-4-82, AND AMENDING THE OFFICIAL STREET MAP. WHEREAS, pursuant to resolution, the City Council of the City of Edmonds, Washington, held public hearings on October 5, 1982 and July 5, 1983, to consider the proposed vacation of certain property in the City of Edmonds, Washington, being a portion of alley east of Seventh Avenue, south of Fir Street, north of Elm Street and west of B Avenue, and more particularly described as set forth on Exhibits A and B attached hereto and incorporated in full by this reference, and WHEREAS, pursuant to the findings of the City's responsible official, the City Council finds that there will be no significant adverse environmental impacts, and WHEREAS, at the conclusion of said public hearing the City Council found that said property dedicated for street purposes should be vacated upon certain conditions and upon payment by the abutting property owners of a portion of the appraised value of the area to be vacated, and WHEREAS, the City Council has set $250.00 per property owner less actual out-of-pocket expenses directly attributable to the processing of this street vacation as reasonable compensation payable to the City by the abutting property owners for the area vacated and the abutting owners have tendered the same to the City, and WHEREAS, the City intends to reserve a 20-foot utility easement and owners of the dominant properties have granted easements for the use and maintenance of the waterline serving the property at 1141 Seventh Avenue from Elm Street so long as such waterline continues to service such property, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The subject property being a portion of alley located east of Seventh Avenue, south of Fir Street, north of Elm Street and west of B Avenue, and as more parti- cularly described in Exhibits A and B, attached hereto and incorporated herein as if set forth in full, is hereby vacated subject to the condition that a twenty foot utility easement be retained in the subject property. Section 2. The City Clerk is hereby directed to file a certified copy of this ordinance with the Snohomish County Auditor. -2- Section 3. The City Engineer is hereby directed to amend the Official Street Map to be consistent with this ordinance. Section 4.
