ORDINANCE NO. 2439
AN ORDINANCE OF THE CITY OF EDMONDS, WASHING -
TON, AMENDING SECTION 5.45.020 OF THE EDMONDS
CITY CODE CONCERNING PENALTIES FOR CRIMINAL
ATTEMPT VIOLATIONS.
WHEREAS, the City Council finds that the jail penalty
provisions for criminal attempt may be inconsistent with the
penalty provisions for the underlying criminal offense, and
WHEREAS, the following addition to the Edmonds Crimi-
nal Code is necessary for the public health, safety and gen-
eral welfare, now, therefore,
FOLLOWS:
THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS
Section 1. A new Section 5.45.020(G) is hereby added
to the Edmonds City Code to read as follows:
Notwithstanding any other City ordinance or pro-
vision of the City Code regarding violations and
penalties, the punishment for an attempt to commit
a crime under Edmonds City Code 5.15.010 is punish-
able by the same fine and imprisonment as the
underlying attempted crime.
Section 2. If any section, sentence, clause or
phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the valid-

ity or constitutionality of any other section, sentence,
clause or phrase of this ordinance.
Section 3. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting
as provided by law.
