AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 4.10.010 OF THE EDMONDS CITY CODE
RELATING TO THE REQUIRED LICENSE FOR TOW TRUCK
REGULATIONS AND FIXING A TIME WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, the City of Edmonds is located within a major
metropolitan area and located adjacent to many other jurisdic-
tions which regulate tow truck operations, and
WHEREAS, the City Council finds and deems it to be within
the public interest to exempt tow truck operations from the
requirement that they obtain a City license for the delivery and
pick up of automobiles provided that they are licensed by one or
more of the adjacent jurisdictions, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That Section 4.10.010 relating to tow truck
license requirements be and is hereby amended to read as follows:
4.10.010 LICENSE REQUIRED
1. No person shall engage in any of the following
activities without first obtaining a tow truck business
license or, with respect to subsection A only, without
being a registered driver of a licensed tow truck
business:
A. Tow or transport or attempt to tow or transport a
motor vehicle for hire from locations within the
City of Edmonds and to destinations within the City
of Edmonds, or
B. Maintain as or in conjunction with a tow truck
business a dispatching office, or storage yard for
tow trucks or impounded vehicles within the City
limits of Edmonds, or
C. Post signs, other than those approved by the State
of Washington for private impoundment of vehicles,
advertising towing services by said person within
the City of Edmonds, or
D. Direct, dispatch, permit or allow a tow truck
driver to tow or transport, or attempt to tow or
transport a motor vehicle, for hire, from locations
within the City of Edmonds and to destinations
within the City of Edmonds.
2. Nothing herein shall be deemed to require any tow truck
business to obtain a tow truck business license from
the City of Edmonds where such tow truck business has a
currently valid tow truck business license from any
other municipal jurisdiction and where such exempted
tow truck business limits its business activities
within the City of Edmonds solely to delivery or pickup
of vehicles from locations within said City.
3. The Chief of Police or his designee shall supply the
Southwest Snohomish County Public Safety Communication
Agency with a list of those tow truck operators
licensed by the City for use in summoning such
operators on a rotating basis for the public
impoundment of vehicles for violation of local
ordinance or for emergency response to accident scenes.
Only operators licensed by the City of Edmonds shall be
placed upon the lists for public impoundment or
accident response within the City of Edmonds.
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
