ORDINANCE NO. 2493
AN ORDINANCE OF THE CITY OF EDMONDS, AMENDING
CHAPTER 20.70 OF THE EDMONDS COMMUNITY DEVELOPMENT
CODE BY THE ADDITION OF A NEW SECTION 20.70.030
PRESUMPTIONS OF VALUE; AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Chapter 20.70 relating to street vacations
is hereby amended by the addition of a new Section 20.70.030
Presumptions of Value to read as follows:
20.70.030 PRESUMPTIONS OF VALUE
In any proceeding by the Hearing Examiner or the Council
regarding the determination of an amount of compensation to
be paid to the City for the vacation of street right-of-way,
it shall be presumed that:
A. Where the vacation of any street right-of-way is
proposed without reserving or retaining to the City the
property proposed for vacation, that property shall be
presumed to have a value equal to 100 percent of the
pro -rated square foot value of the average of the
abutting lots as such value has been determined in
accordance with the assessed valuation placed upon said
property by the Snohomish County Assessor.
B. Where the City will retain a utility or other public
easement on or across the property proposed for
vacation, the property will be presumed to have a value
equal to 75 percent of the pro -rated square foot value
as determined by subparagraph A, above.
The preceding presumptions of value shall be rebuttable and
the City, any citizen, or the person upon whose application
the vacation is being considered may present evidence to the
contrary.

Section 2. This ordinance shall be in full force and
affect five (5) days after passage and publication by posting as
provided by law.
