Currently the designated use of your property is a single-family dwelling. Once you invite the general public into your home and change the use of existing rooms or areas, the Uniform Building Code requires that certain life -safety factors be met to ensure the safety of the occupants and surrounding property. The city has received two formal complaints about the business, which specifically point out that no notice was provided, a sign was erected, and that parking for 40 to 60 guests would be problematic, particularly with kids at the park. In response to these complaints I drove by the site and saw a sign advertising the Enchanted Gardens business. Our letter advised you that in order` to operate Enchanted Gardens as described in your business license application and the newspaper, a Conditional Use permit would be required. Also, a change of use permit for assembly uses would be required which typically demands life -safety code upgrades to ensure the safety of the occupants and surrounding properties. Because you are proposing a business use including outdoor activities, you will need to apply for a Conditional Use permit to allow your home occupation. Residential zones have very strict sign regulations. The only sign normally allowed for single family residences are individual residence signs with only the name and address of the resident. These signs cannot exceed three square feet in area. The only other option is a sign for a conditional nonresidential use in a residential area. To be allowed a sign under this category you must have gone through the Conditional Use. permit process and been approved for a nonresidential use. If that is the case, the size of sign allowed is not to exceed 10 square feet and no interior lighting is allowed. No sign for Enchanted Gardens can be allowed until a Conditional Use permit is approved for the business. Submit for a change of use.permit and provide the three referenced items above for Building and Fire Code review (fee $60); C. Remove the Enchanted Garden sign until a Conditional Use permit is approved.
