17.40.030
C. Combination. If, since the date on which
it became nonconforming due to its failure to
meet minimum lot size or width criteria, an
undeveloped nonconforming lot has been in
the same ownership as a contiguous lot or lots,
the nonconforming lot is and shall be deemed
to have been combined with such contiguous
lot or lots to the extent necessary to create a
conforming lot and thereafter may only be
used in accordance with the provisions of the
Edmonds Community Development Code,
except as specifically provided in subsection D
of this section.
D. Exception for Single -Family Dwelling
Units. An applicant may build one single-fam-
ily dwelling unit on a lot or parcel regardless of
the size of the lot or parcel if, but only if, one
of the following exceptions applies:
1. In an RS zone, such nonconforming
lot may be sold or otherwise developed as any
other nonconforming lot pursuant to the fol-
lowing conditions and standards:
a. The lot area of the nonconforming
lot is not less than the minimum lot area spec-
ified in the table below for the zoning district
in which the subject property is located, and
b. Community facilities, public utili-
ties and roads required to serve the noncon-
forming lot are available concurrently with the
proposed development, and
c. Existing housing stock will not be
destroyed in order to create a new buildable
lot, and
d. The proposed development of the
lot is generally consistent with the character of
the surrounding neighborhood.

2. An applicant applies for necessary
permits to construct the unit within five years
to the date the lot or parcel is annexed into the
city and the lot or parcel was lawfully created
under provisions of Snohomish County subdi-
vision and zoning laws as well as the laws of
the state of Washington; or
3. An applicant may remodel or rebuild
one residence on a nonconforming lot without
regard to the 50 percent destruction require-
ment of ECDC 17.40.020(F) if a fully com-
pleted building permit is permitted within one
year of the destruction of the residence and all
other development requirements of this code
are complied with; or
4. The lot lines defining the lot or parcel
were recorded in the Snohomish County
recorder's office prior to December 31, 1972,
and the lot or parcel has not at any time been
simultaneously owned by the owner of a con-
tiguous lot or parcel which fronts on the same
access right-of-way subsequent to December
31, 1972, and the lot or parcel has access to an
access right-of-way which meets the minimum
requirements established by this code; or
5. The owner of a lot which was law-
fully created under the Snohomish County
subdivision and zoning laws and which was
annexed to the city of Edmonds on or after
December 16, 1958, may file a fully completed
building permit application for a development
lot in accordance with the provisions of this
chapter and develop the lot if a fully completed
building application to develop said lot was
filed with the city on or before the date estab-
lished by Ordinance No. 3024. This paragraph
(D)(5) shall sunset and be removed from the
code two years after the effective date of the
passage of Ordinance No. 3024 and is intended
to provide a window of opportunity for those
persons who comply with the provisions of
subsection D of this section but who are barred
due to the passage of time an equal opportunity
to develop a lot in accordance with the provi-

17.40.040
17.40.040 Nonconforming signs.
Nonconforming signs are injurious to the
health, safety and welfare and destructive of
the aesthetic and environmental living condi-
tions which this zoning ordinance is intended
to preserve and enhance. Nonconforming
signs shall be brought into compliance with the
provisions of Chapter 20.60 ECDC under the
following terms and conditions:
A. No nonconforming sign shall be
expanded, extended, rebuilt, reconstructed or
altered in any way; provided, however that the
following acts are specifically permitted and
shall not in and of themselves require con-
formance with the provisions of Chapter 20.60
ECDC:
1. Normal maintenance of the sign;
2. A change in the name of the business
designated on the sign; or
3. Any action necessary to preserve the
public safety in the event of damage to the sign
brought about by an accident or an act of God.
B. Any nonconforming sign shall be
brought into immediate compliance with the
code in the event that:
1. An act prohibited by the provisions of
subsection A of this section occurs;
2. The building to which the noncon-
forming sign or signs is appurtenant is remod-
eled or receives an addition equal to 25 percent
of the building's value prior to the addition or
remodeling;
3. A change in the use of the building to
which the sign is appurtenant or the land upon
which the sign is located occurs; or
4. An application for the erection of a
new sign or signs is made by the owner or les-
see of the business premises to which the sign
is appurtenant.
C. None of the foregoing provisions relat-
ing to permitted maintenance, name change or
preservation of the sign under paragraph A of
this section shall be construed so as to permit
the continuation or preservation of any non-
conforming off -premises sign. [Ord. 2429,

The purposes of this chapter are:
A. To reduce street congestion and avoid
crowding of on -street parking space;
B. To require adequate landscaping of off-
street parking areas;
C. To protect adjacent property from the
impact of a use with inadequate off-street park-
ing.
17.50.010 Off-street parking required.
A. New Uses or Structures.
1. Off-street parking facilities which
comply with this chapter shall be provided
before any new use is begun, or any new struc-
ture is approved for occupancy. A detailed
plan and provisions specifically setting forth
the method and location by which the off-
street parking required for the proposed use
will be met, whether by construction, a joint
use agreement, and in lieu of parking fee, or
any other method provided by this code, shall
be filed and approved in conformance with the
applicable provisions of this code before any
building permit is issued.

18.90.000 Purpose.
The purpose of this chapter is to:
A. Implement the comprehensive sidewalk
plan.
B. Regulate the construction of improve-
ments which could prevent the implementation
of the comprehensive sidewalk plan. [Ord.
2477 § 2, 1985].
18.90.010 Sidewalk plan adopted.
A map, which is on file with the office of the
city clerk and city engineer, entitled Compre-
hensive Sidewalk Plan — 1984, is adopted by
this reference as if set forth in full in this chap-
ter. Changes shall be by ordinance, attested by
the mayor and city clerk on the affected map.

18.90.020 Effect.
The city council shall use the map to assist
it in determining the priority of streets for side-
walk construction. Development along those
streets designated for sidewalks shall be
required to include sidewalks designed to the
specifications of this chapter as a condition of
development approval, as said term is defined
in ECDC 15.40.010. [Ord. 2477 § 2, 1985].
18.90.030 Sidewalk standards.
Sidewalks to be constructed as a condition
of development approval shall be constructed
as shown in the Table of Sidewalk Standards
below. The city engineer will prepare draw-
ings illustrating the sidewalk standards.

1 Except as shown on comprehensive sidewalk plan map or as re-
quired by the planning director and city engineer.
Note: It is the city's policy to require sidewalks on all streets over
300 feet in length.
2 Requirements are optional to encourage flexibility of location,
alignment, specifications, and materials to insure compatibility with
individual locations and circumstances. The planning director and
city engineer shall make the final decision on the requirements after
review of pertinent information supplied by the affected neighbor-
hood and/or the architectural design board.
3 Corner parks will be required at all street intersections, per city stan-
dard, within the downtown business area and may be required in all
other commercial areas.
A. Location. Streets designated on the
Comprehensive Thoroughfare Map as an arte-
rial street shall have sidewalks constructed on
both sides of the street. Designated collector
streets shall have sidewalks constructed on at
least one side of the street.
B. Regulation. The planning director and
the city engineer will be responsible for deter-
mining the width and materials to be used for
sidewalks as set forth in the table above.
With the approval of both the planning
director and city engineer, the requirements of
this chapter may be waived, if it can be demon-
strated by the applicant that there are special
circumstances related to topography or other
factors which make the construction of the
sidewalk economically unfeasible or practi-
cally impossible. [Ord. 2477 § 2, 1985].
18.90.040 Sidewalk maintenance.
The duty of an adjacent property owner to
maintain a sidewalk and a planting strip are
governed pursuant to Chapter 9.20 ECC,
incorporated by this reference as fully as if
herein set forth. [Ord. 3149 § 1, 1997].

20.105.000 Scope.
This section provides the basic procedure
for processing appeals. In the event another
chapter in Title 20, except Chapter 20.90
ECDC, sets different specific requirements for
appeal procedures, this chapter shall control.

20.105.010 Appealable decisions.
A. Staff Decisions. Any person may appeal
a decision of staff, on the following matters, to
the hearing examiner in the manner provided
in this chapter.
1. Short subdivisions and lot line adjust-
ments.
2. Home occupations.
3. Interpretations of the text of the
ECDC; provided, however, that where specific
appeal procedures are provided for by this
code or an incorporated statute such as but not
limited to Title 19 of the State Building Codes,
such specific appeal procedures shall control.
4. SEPA (Chapter 43.21C RCW) deci-
sions in accordance with the provisions of
Chapter 20.15A ECDC as the same exists or is
hereafter amended.
5. Permits or approvals required by
ECDC Title 18 (Public Works Requirements).
6. Appeals of required dedications of
right-of-way and the reconnection charge
established under the provisions of ECC
7.10.065.
7. Sign permits.
8. Critical areas staff decisions in accor-
dance with the provisions of ECDC Chapter
20.15B as the same exists or is hereafter
amended.
9. Such other matters as may be specifi-
cally referred by the ECDC.
B. Hearing Examiner Decisions. Any per-
son may appeal a final decision of the hearing
examiner identified in ECDC 20.100.010(B)
to the city council in the manner provided in

20.105.020 Appeal — Filing.
A. Written Appeal. Appeals shall be writ-
ten and shall state the following:
1. The decision being appealed, the
name of the project applicant and the date of
the decision.
2. The name and address of the person
appealing, and his or her interest in the matter.
3. The reasons why the person appealing
believes the decision to be wrong.
4. Persons to be notified under subsec-
tion B below, including correct names and
addresses.
B. Filing the Appeal. The person appealing
shall file the appeal with the director of com-
munity services within 14 calendar days after
the date of the decision being appealed. If an
appeal is properly filed within the time limit,
the appealed decision shall be suspended until
the appeal has been acted on, and no further
development action which was the subject of
the decision may be taken. If no public hearing
has been held earlier, the person appealing
shall also provide a list of property owners as
specified in ECDC 20.95.010 and whom must
be notified by the community services depart-

20.105.030
20.105.030 Appeal of staff decision.
A. Who May Appeal. Persons entitled to
appeal are:
1. The applicant; or
2. Anyone who has submitted a written
document to the city of Edmonds concerning
the application prior to issuance of the staff
decision; or
3. Anyone within 300 feet of the prop-
erty which is the subject of the application, or
who can demonstrate an interest in the action.
B. Department Action. The community ser-
vices department shall promptly:
1. Send a copy of the appeal to the
project applicant if the person appealing is not
the applicant.
2. Give notice of the hearing as speci-
fied in Chapter 20.91 ECDC.
3. Send a copy of the notice of hearing to
the person appealing.
4. Provide a copy of the staff report and
decision, minutes of the hearing held on the
decision, a response to the appeal, and other
relevant documents, to the hearing examiner.
The project applicant, person appealing and
other interested parties shall be notified in
writing that the materials are on file and may
be reviewed and/or copied at the expense of
the person wishing the copies.
C. Public Hearing. The hearing examiner
shall hold a public hearing on the appeal in the
manner provided in Chapter 20.91 ECDC. The
hearing examiner shall base the decision on the
appeal on the same criteria and findings as set
forth in this code for the original decision.
D. Appeal of Hearing Examiner Decision.
The decision of the hearing examiner on
appeals of staff decisions on project permit
applications shall be final and shall not be
appealable to the city council. Hearing exam-
iner decisions on appeals of staff decisions that
do not involve project permit applications
shall be appealable to the city council pursuant
to the process specified in ECDC 20.105.040.

20.105.040 Appeal of hearing examiner
action.
A. Who May Appeal. Persons entitled to
appeal are:
1. The applicant; or
2. Anyone who has submitted a written
document to the city of Edmonds concerning
the application prior to or at the hearing identi-
fied in ECDC 20.100.010; or
3. Anyone testifying on the application
at the hearing identified in ECDC 20.100.010.
B. Department Action. The community ser-
vices department shall promptly:
1. Send a copy of the appeal to the hear-
ing examiner and to the applicant if the person
appealing is not the applicant.
2. Send a copy of the appeal to the city
clerk, along with copies of reports, hearing
minutes and any other relevant material that
the hearing examiner has not already sent to
the council as part of his or her decision.
C. City Clerk Action. After receiving
notice of an appeal of a hearing examiner
action, the city clerk shall promptly:
1. Set the meeting on the appeal on a city
council agenda for a date that is within 30 days
of the date the appeal was filed.
2. Give notice of the meeting as speci-
fied for public hearings in Chapter 20.91
ECDC.
3. Send a notice of the hearing to the
person appealing.
D. City Council Review.
1. The council shall consider the appeal,
including review of the record, in a closed
record appeal. The parties to the appeal may
submit timely written statements or argu-
ments.
2. The council shall review the proposal
using the same criteria and findings set forth in
this code for the original decision.
3. The council shall state its findings
and conclusions regarding the appeal. The
council may take either of the following
actions:
a. Affirm, modify or reverse the
action of the hearing examiner; or
