Therefore, should any part of this code be
declared invalid or unconstitutional for any
reason, this declaration shall not affect the
validity or constitutionality of the remaining
parts of this code.

COMPREHENSIVE PLAN — ADOPTION

15.05.000 Adopted.
A. 1997 Amendments Adopted. The 1997
Edition of the Edmonds Comprehensive Plan,
attached to the ordinance codified in this sec-
tion and incorporated by this reference as if set
forth in full, is hereby adopted as the official
comprehensive plan for the city of Edmonds,
as required by the Washington State Growth
Management Act, Chapter 35.70A RCW.
Amendments to the 1995 Edition of the
Edmonds Comprehensive Plan are identified
by text that is either underlined (denoting new
language) or st-fieken (denoting text that has
been deleted). In addition, the 1995 Edition of
the Edmonds Comprehensive Plan Concept
Map and Figure 9 in the 1995 Edition of the
City of Edmonds Transportation Element have
been replaced for the 1997 Edition of the
Edmonds Comprehensive Plan. Nothing in the
1997 amendment to this section shall be con-
strued as a readoption of the Edmonds Com-
prehensive Plan in its entirety, or an
amendment of any material not identified as an
amendment in this section.
B. Location of Comprehensive Plan Cop-
ies. Copies of the 1997 Edition of the Edmonds
Comprehensive Plan, including all documents
incorporated by reference, shall be maintained
on file in the planning department and in the
office of the city clerk for inspection by the
public.
C. Attachments to the Comprehensive
Plan. The 1997 Edition of the Edmonds Com-
prehensive Plan adopts several maps, plans
and other documents by reference. These doc-
uments are incorporated into the comprehen-
sive plan by reference as if set forth in full.

RM — MULTIPLE RESIDENTIAL

16.30.000 Purposes.
The RM zone has the following specific
purposes in addition to the general purposes
for residential zones of ECDC 16.00.010 and
16.10.000:
A. To reserve and regulate areas for a vari-
ety of housing types, and a range of greater
densities than are available in the single-fam-
ily residential zone, while still maintaining a
residential environment;
B. To provide for those additional uses
which complement and are compatible with
multiple residential uses.
16.30.010 Uses.
A. Permitted Primary Uses.
1. Multiple dwellings;
2. Single-family dwellings;
3. Retirement homes;
4. Group homes for the disabled, foster
family homes and state licensed group homes
for foster care of minors; provided, however,
that halfway houses and group homes licensed
for juvenile offenders are not permitted uses in
a residential zone of the city;
5. Boarding houses and rooming houses;
6. Housing for low income elderly in
accordance with the requirements of Chapter
20.25 ECDC;
7. Bus stop shelters.
B. Permitted Secondary Uses.
1. All permitted secondary uses in the
RS zone, if in conjunction with a single-family
dwelling;
2. Home occupations, subject to the
requirements of Chapter 20.20 ECDC;
3. The keeping of one domestic animal;
4. The following accessory uses:
a. Private parking,
b. Private swimming pools and other
private recreational facilities,
c. Private greenhouses covering no
more than five percent of the site in total;
5. Commuter parking lots containing
less than 10 designated parking spaces in con-
junction with a limited community facility
meeting the criteria listed under ECDC
16.20.010(C)(1), except that the facility may
also be located along a designated transit route
in addition to an arterial or collector street.
Any additionally designated parking spaces
that increase the total number of spaces in a
commuter parking lot to 10 or more shall sub-
j ect the entire commuter parking lot to a condi-
tional use permit as specified in ECDC
16.30.010(D)(3), including commuter parking
lots that are located upon more than one lot as
specified in ECDC 21.15.075.
C. Primary Uses Requiring a Conditional
Use Permit.
1. Offices;
2. Community facilities, including
buildings used for community activities and
services, such as:
a. Schools, colleges, universities,
b. Preschools, day-care centers,
c. Hospitals, convalescent homes,
rest homes, sanitariums,
d. Churches, temples, synagogues,
e. Fire houses, police stations,
f. Electric substations, pumping sta-
tions, water storage, drainage facilities, trans-
mitting and receiving antennas,
g. Parks, playgrounds, pools, golf
courses, tennis clubs, lodges,
h. Museums, libraries, art galleries,
zoos, aquariums, planetariums,
i. Counseling centers and residential
treatment facilities for current alcoholics and
drug abusers.
D. Secondary Uses Requiring a Condi-
tional Use Permit.
1. Family day-care homes;

2. Mini day-care facilities; provided
that:
a. Mini day-care facilities shall not be
operated from or within a multiple family
dwelling unit or combination of units, but
b. A permit may be issued for a mini
day-care facility to be operated in a separate,
nonresidential portion of a multi -family resi-
dential dwelling structure operated primarily
for the benefit of the residents thereof;
3. Commuter parking lots with 10 or
more designated parking spaces in conjunction
with a limited community facility meeting the
criteria listed under ECDC 16.20.010(C)(1),
except that the facility may also be located
along a designated transit route in addition to

16.30.020 Subdistricts.
There are established three subdistricts of
the RM zone, in order to provide site develop-
ment standards for areas which differ in topog-
raphy, location, existing development and
other factors. These subdistricts shall be
known as the RM-1.5, RM-2.4, and RM-3
zones.

16.50.000 Purposes.
The BC zone has the following specific pur-
poses in addition to the general purposes for
business and commercial zones listed in Chap-
ter 16.40 ECDC.
A. To reserve areas for those retail stores,
offices, service establishments and amusement
establishments which offer goods and services
to the entire community;
B. To ensure compact, convenient develop-
ment patterns by allowing uses that are oper-
ated chiefly within buildings;
C. To allow for mixed -use development
which includes multiple dwelling unit(s) that
support business uses. [Ord. 3147 § 1, 1997].
16.50.010 Uses.
A. Permitted Primary Uses.
1. Single-family dwelling, as regulated
in RS-6 zone;
2. Retail stores, offices and service uses,
excluding intense uses, such as trailer sales,
used car lots (except as part of a new car sales
and service dealer), and heavy equipment sales
and services;
3. New automobile sales and service;
4. Dry cleaning and laundry plants
which use only nonflammable and nonexplo-
sive cleaning agents;
5. Printing, publishing and binding
establishments;
6. Bus stop shelters;

licensed pursuant to provisions in the
Edmonds City Code;
8. Multiple Dwelling Unit(s). This use
may not be located on the ground floor of a
structure.
B. Permitted Secondary Uses.
1. Limited assembly, repair or fabrica-
tion of goods incidental to a permitted or con-
ditional use;
2. Off-street parking and loading areas
to serve a permitted or conditional use;
3. Commuter parking lots in conjunc-
tion with a limited community facility meeting
the criteria listed under subsection (C)(2) of
this section, except that the facility may also be
located along a designated transit route in
addition to an arterial or collector street.

B. Ground Floor. Development on the
ground floor must consist of only commercial
uses to a minimum depth of 30 feet as mea-
sured from the street front of the building, with
the exception that the provision of pedestrian
access to permitted residential uses is allowed.
This provision does not apply when a single-
family use is the primary use on the property.
C. Signs, Parking and Design Review. See
Chapters 17.50, 20.10, and 20.60 ECDC.
D. Density. There is no maximum density
for permitted multiple dwelling units.
E. Screening. The required setback from R
zoned property shall be permanently land-
scaped with trees and ground cover and perma-
nently maintained by the owner of the BC lot.
A six-foot minimum height fence, wall or solid
hedge shall be provided at some point in the
setback.
F. Satellite Television Antennas. Satellite
television antennas shall be regulated as set
forth in ECDC 16.20.050 and reviewed by the

B. All new permits for the annexation area
filed and initiated in the city of Edmonds after
the date of annexation and any existing per-
mits, upon the expiration of their vesting rights
or the passage of one year, whichever comes
first, shall be transferred to the city of Edmonds
for administration in accordance with the pro-
cedural requirements of the Edmonds Commu-
nity Development Code and the substantive
requirements in which the permittee has
vested. Copies of these interim zoning regula-
tions as adopted are on file with the Edmonds
city clerk and the Edmonds planning depart-
ment. Copies of such ordinances are available

17.05.010 Purpose.
This chapter has been enacted to authorize
the community services director or his desig-
nee to waive or vary provisions of the Ed-
monds Community Development Code when
necessary to reasonably accommodate the stat-
utory rights of the disabled under the Ameri-
cans with Disabilities Act (ADA), the Fair
Housing Act (FHA) or the Washington Law
Against Discrimination (WLAD). This pro-
cess shall be interpreted and administered in
order to ensure the full exercise and enjoyment
of a disabled person's right to the residential
housing of his or her choosing. The provisions
of this chapter shall not apply to commercial
activities or zones; provided, however, that
nothing herein shall be interpreted to limit the
exercise of a disabled person's rights by or
through a residential care provider. In the
event of any conflict or if an interpretation of
this chapter is required, it shall be imple-
mented and interpreted in accordance with the
provisions of the Americans With Disabilities
Act, the Fair Housing Act and the Washington
Law Against Discrimination. [Ord. 3142 § 2,
1997] .
17.05.020 Reasonable accommodations.
A. Upon the application of a disabled per-
son or individual or entity providing services to

the disabled in a residential facility or other
group living arrangement, the community ser-
vices director or his designee is hereby autho-
rized to vary, modify, or waive the provisions
of the Edmonds Community Development
Code, including the provisions of ECDC Title
19, in order to provide a reasonable accommo-
dation as necessary to provide to a disabled
person's or care provider to the disabled's full
enjoyment of a residence.
B. The city's duty to accommodate is an
affirmative one, and the community services
director is thereby authorized to provide
accommodations in a thoughtful and proactive
manner.
C. The following review may, at the discre-
tion of the community services director,
include citizen input into the administrative
process. The community services director shall
provide written notice of the accommodation
to the applicant and property owners within
300 feet of the subject site.
D. When applying this reasonable accom-
modation process to the Edmonds Community
Development Code, including the State Build-
ing Code and other codes adopted pursuant to
ECDC Title 19 and Chapter 19.05 ECDC, the
staff shall avoid the stereotypical assumptions
regarding the disabled and shall attempt to
ascertain the actual physical and/or mental lim-
itation of the disabled individual in order to
craft an accommodation which best suits the
exercise of that individual's rights. [Ord. 3183
§ 1, 1998; Ord. 3142 § 2, 1997].
17.05.030 Waiver of building code
requirements.
No reasonable accommodation shall be pro-
vided by a waiver or variance of the provisions
of the codes adopted pursuant to Chapters
19.00 and 19.05 ECDC which does not sub-
stantially accomplish the purposes of those
chapters or which would reduce the fire safety
of any structure. Modifications, waivers or
variances of the provisions of Uniform Build-
ing Code, Uniform Fire Code and the other
codes adopted pursuant to Chapters 19.00 and
19.05 ECDC shall provide at least the same
level of safety required by the respective state
code. The applicant shall have the burden of
establishing that the proposed modification,
waiver or variance accomplishes substantially
the same purpose without reduction of fire

17.05.040 Accommodations personal to
the applicant.
The accommodation provided shall be per-
sonal to the applicant and shall not run with the
land; provided, however, that a change in a res-
idential structure necessary to accommodate
the operation of a residential care provider to
the disabled may be continued by future oper-
ations of similar facilities at the site who estab-
lish the same use within six months of the date
the prior use by disabled person or residential
care provider ceases. The community services
director may therefore direct that any physical
change in the structure which would otherwise
be illegal under the use or bulk requirements of
the Community Development Code be brought
into compliance six months after the date of
sale or transfer of a residential structure to a
person or entity not qualifying for the protec-
tions of the ADA, FHA and WLAD. [Ord.

17.05.050 Appeal.
There shall be no appeal from the decision
of the community services director within the
city. Interested persons, that is persons located
within 300 feet of the building site, may appeal
the reasonable accommodation by filing a peti-
tion for review with Snohomish County Supe-
rior Court within 10 days of the date of mailing
of the written notice of decision. [Ord. 3142 §

provisions of this code whenever the
permit is issued in error or on the basis
of incorrect information supplied, or in
violation of any ordinance or regulation
of any of the provisions of this code,
other ordinance, or other applicable
law.
H. Utilities and Street Improvements.
No building permits shall be issued for
the construction, enlargement, alter-
ation, improvement or conversion of
any building or structure of any kind or
description unless the plans and spec-
ifications include the construction of
curbs, gutters, sidewalks, paved
streets, waterlines, sewerlines, and
storm drainage necessitated by the
new construction, conversion, alter-
ation, enlargement or improvement.
These street and utility improvements
are to be built to applicable city stan-
dards. If the director of public works
finds it to be impractical for one appli-
cant to construct the improvements at
the time of application for the building
permit, construction may be deferred
by the director. In this case, a perfor-
mance bond shall be filed with the city
to cover the estimated cost of construc-
tion to city standards for the improve-
ments. Lots which have received final
approval as a subdivision, shall be
deemed to be in compliance with this
subsection if all requirements of the
subdivision have been met.
I. Hazardous Sites. Building, grading
and excavation permits for construc-
tion on land which the community ser-
vice's director finds to be unsuitable for
improvement due to flooding or inade-
quate drainage for the plans submit-
ted, shall be denied. In making this
determination, the director shall con-
sider not only the land which is the
subject of the application, but in addi-
tion, the surrounding area which would
be adversely affected if the permit
were granted.
J. Septic System. No occupancy per-
mit or building permit shall be issued
for the construction, alteration, im-
provement or occupancy of any build-
ing or structure having or required to
have a sewage disposal system un-
less the applicant for the occupancy or
building permit has complied with the
provisions of Chapter 18.20 ECDC.

19.00.030 Drainage and grading.
A. Drainage Improvements. Gutters, drain
lines and inlets or other necessary drainage
structures shall be installed where storm water
disposal cannot be obtained without their use
or where erosion cannot be prevented by fin-
ished grading and planting. Drywells shall be
installed only in areas having open, well -
drained porous soils. Design, construction and
installation of drainage structures shall be in
accordance with Chapter 18.30 ECDC.
B. Grading Requirements. The builder or
owner shall grade the site to insure:
1. Diversion of water away from build-
ings;
2. Prevention of standing water and soil
saturation and provision for disposal of water
from lot; in accordance with Chapter 18.30
ECDC;
3. Protection of adjoining property.
19.00.040 Covenant for multiple
residential buildings.
Before a building permit for the construc-
tion of any multiple residential building is
issued, the applicant shall file with the building
official a covenant running from the owners of
the real property upon which the building or
structure is to be built, as grantors, to the city
of Edmonds, as grantee. The covenant shall
state the maximum number of dwelling units
permitted under the then existing ordinances
of the city to be constructed on the real prop-
erty therein described for which the building

permit application has been made. The cove-
nant shall be recorded at the cost of the appli-
cant with the Snohomish County auditor. The
covenant shall be a restriction that shall run
with the land and provide notice to later pur-
chasers of the number of dwelling units per-
mitted to be built upon the site. The building
official may require the applicant to furnish a
report from a title insurance company doing
business in Snohomish County to verify the
ownership of the grantor.
19.00.050 Demolition permits.
Before the demolition of any building or
structure, a demolition permit shall be
obtained from the building official. The permit
fee shall be as stated in Chapter 15.00 ECDC.
The applicant shall also post with the city a
performance bond, or a cash deposit, conform-
ing to Chapter 17.10 ECDC herein, in an
amount to be determined by the building offi-
cial to satisfy all city code requirements not
later than six months after the issuance of the
permit. The performance bond or cash deposit
shall not be released until the following are
accomplished at the vacated site, to the satis-
faction of the building official:
A. Plug or cap any abandoned sewers, as
required by the Uniform Plumbing Code, sec-
tion 1119, adopted by this title;
B. Knock down of concrete foundation
walls, porches, chimneys and similar struc-
tures, and grading of lot to fill voids;
C. Septic tanks to be pumped, collapsed
and/or filled with earth;
D. Removal of debris from property;
E. Repair of any damage to and restoration
of any public or private property to substan-
tially original condition;
F. Written request that water service be
turned off and meter removed by the depart-
ment of public works.
19.00.055 Mobile home installation
standards.
A. Except as hereafter amended, WAC
296-150B-200 through and including 296-
150B-255 as currently promulgated together
with any future amendments thereof or future
additions thereto are hereby adopted by this
reference and incorporated into the Edmonds
Community Development Code as if set forth
herein in full. The building official, or desig-
nee, is authorized to inspect the installation of
mobile homes, issue building permits for the
installation of all mobile homes that meet the
requirements of this chapter and enforce all
violations of this chapter.
B. All references to "installation permits"
in WAC 296-150B-200 through and including
WAC 296-15013-255, as herein adopted by ref-
erence shall refer to building permits issued for
the installation of mobile homes.
C. Fees for the issuance of a building per-
mit for the installation of a mobile home shall
be computed as provided by the Uniform
Building Code, as adopted by this chapter.

19.00.060 Interpretation, appeals and
alternate materials.
A. Interpretation. Whenever provisions of
this chapter and the Uniform Building Code as
adopted conflict with the provisions of the
Edmonds zoning ordinances contained in this
code, the provisions of the zoning ordinance
shall control.
B. Appeals. Appeals from the building offi-
cial's interpretation of the Uniform Building
Code, determinations of suitable, alternative
methods or materials, and any other appeal
delegated to a board of appeals pursuant to the
Uniform Code for the Abatement of Danger-
ous Buildings, the Uniform Mechanical Code,
the Uniform Plumbing Code and any and all
other codes adopted pursuant to the direction
and authority of Chapter 19.27 RCW are
hereby directed to the city's hearing examiner
for hearing in accordance with the procedures
established to such codes; provided, however,
that any denial or grant of permit or interpreta-
tion of any code arising with respect to any
tract of land lying within the earth subsidence
and landslide hazard area set forth and defined

in Chapter 19.05 ECDC shall be appealable
directly to and only to the Snohomish County
Superior Court by writ of certiorari. Any con-
flict or doubt shall be resolved in favor of the
sole jurisdiction of the Superior Court.
Appeals to Superior Court shall be instituted
within 10 calendar days of the date of the mail-
ing of the written decision of the building offi-
cial. As provided in the codes, appeal of the
actions of the building official and/or hearing
examiner sitting as the building code board of
appeals shall be taken, as appropriate by writ
of certiorari or writ of mandamus to the Sno-
homish County Superior Court.
C. Alternate Materials. Determination of
the suitability of materials and types of con-
struction may be made by application to the
board of appeals pursuant to Chapter 10.15
ECC.* [Ord. 2939 § 2, 1993; Ord. 2576, 1986].

19.00.070 Fees.
Section 3310 of Appendix Chapter 33 and
section 107.2 of the 1994 edition of the Uni-
form Building Code are hereby repealed and
replaced with the following:
A. Plan -Checking Fee. The amount of
the plan -checking fee for grading, ex-
cavation and/or fill plans shall be as set
in Chapter 15.00 ECDC. Before ac-
cepting a set of plans and specifica-
tions for checking, the building official
shall collect the plan -checking fee.
Separate permits and fees shall apply
to retaining walls or major drainage
structures as indicated elsewhere in
this code. There shall be no separate
charge for standard terrace drains and
similar facilities.
B. Grading Permits. A fee for each
grading permit shall be paid to the
building official as set by Chapter
15.00 ECDC.
C. Group R-1 and M-1 Occupancies.
Fees for Group R-1 and Group M-1 oc-
cupancies shall be as set in Chapter
15.00 ECDC.
D. Fences. Fence permit fees shall be
as set in Chapter 15.00 ECDC.
E. Compliance Inspections. Housing
compliance inspection fees shall be as
set in Chapter 15.00 ECDC.
F. Relocation. Fees for the relocation
of a building (moving permit) shall be
as set in Chapter 15.00 ECDC.

19.00.080 Penalties.
Section 205 of the Uniform Building Code
as adopted herein is hereby amended and set
forth as follows:
It is unlawful for any person, firm, cor-
poration or other organization to erect,
construct, enlarge, alter, repair, move,
improve, remove, convert or demolish,
equip, use, occupy or maintain any
building or structure in the city, or
cause the same to be done, contrary to
or in violation of any of the provisions
of this chapter.
Any person, firm, corporation or other
organization violating any of the provi-
sions of the Uniform Building Code as
adopted herein, or other provision of
this chapter, shall be guilty of a misde-
meanor, and shall be deemed guilty of
a separate offense for each and every
day or portion thereof during which any
violation of any of the provisions of this
chapter or the Uniform Building Code
adopted herein is committed, contin-
ued or permitted, and upon the convic-
tion thereof of such violation, and each
violation thereof such person, firm,
corporation or other organization, and
the officers, directors and managers

thereof, shall be punishable as set
forth in ECC 5.50.020.
19.00.110 Fully complete application.
In accordance with the provisions of RCW
19.27.095, an applicant's rights shall vest when
a fully complete building permit application is
filed. A fully complete building permit appli-
cation is an application executed by all of the
owners of the property for which the applica-
tion is submitted or the duly authorized
agent(s) for such owners, containing each and
every document required under the terms of
these ordinances and the Uniform Building
Code and substantially complete in all respects.
It is anticipated that minor changes or revisions
may be required and are frequently made in the
course of any building application review pro-
cess, and such minor revisions or changes shall
not keep an application from being deemed
complete if a good faith attempt has been made
to submit a substantially complete application
containing all required components. Where re-
quired, the application and supporting docu-
ments shall be stamped and/or certified by the
appropriate engineering, surveying or other
professional consultants. A fully complete
building permit application shall be accompa-
nied by all fees, including but not limited to
building permit fees and plan check fees re-
quired under the provisions of this chapter and
the State Building Code. [Ord. 2769 § 1, 1990].
19.00.115 Letter of completeness.

19.00.120 Architectural design review —
Optional vesting.
In addition to the vesting rights created by
RCW 19.27.095 and ECDC 19.00.110, an
applicant for development as defined in ECDC
20.10.010 and subject to architectural design
review may, at the applicant's option, file a
fully complete augmented architectural design
review application (hereinafter "augmented
ADB application") and vest rights under the
provisions of the Edmonds Community Devel-
opment Code and the State Building Code as
adopted and amended by the city of Edmonds,
ECDC Title 19 as then in effect.
A. Fully Complete, Augmented Applica-
tion for Architectural Design Review. An aug-
mented ADB application shall consist of-
1. A complete application for architec-
tural design review, executed by each and
every property owner of record of the develop-
ment site or their duly authorized agent(s),
accompanied by the following:
a. All fees required by ordinance,
including impact mitigation fees to be depos-
ited at the time such SEPA requirements
become final.
b. A site plan showing the current
zoning of the development site, the footprint of
all proposed structures, the total square footage
of the development structures and each sepa-
rate floor thereof, all setbacks required by ei-
ther the zoning code or state building codes,
proposed parking configurations, and en-
trances and fire exit (if separate).
c. Elevation drawings showing the
original grade of the site, any proposed alter-
ations to grade, the proposed height of the
structure and the number of stories.
d. A letter executed by all owners of
record or their duly authorized agent(s) detail-
ing the proposed use in sufficient detail to
determine whether the proposed use complies
with the zoning code then in effect and suffi-
cient, in conjunction with the other materials to
determine the occupancy classifications of the
Uniform Building Code and the Uniform Fire
Code as those codes then in effect.
e. A building permit application is
described in section 106.3.1 of the 1994 edi-
tion of the Uniform Building Code as the same
exists or is hereafter amended, and all building
permit and plan check fees — provided that the
plans required by section 106.3.1 and section
106.3.3 of the 1994 edition of the Uniform
Building Code (UBC) as the same exists or is
hereafter amended and other engineering doc-
uments, plans or drawings required by ECDC

Title 18 may be submitted within 90 days of
final architectural design board approval, or
final approval on appeal.
B. Vesting. Upon filing of the augmented
ADB application, the applicant shall be
deemed fully vested as if a fully complete
building permit application had been filed; pro-
vided:
1. The burden shall be upon the appli-
cant to supply all material required by the pro-

authorized to take such actions as may be nec-
essary to enforce the provisions of this chapter.
C. Appeals. Any decision to require a criti-
cal areas study pursuant to this chapter may be
appealed to the hearing examiner pursuant to
Chapter 20.105 ECDC. Any decision to
approve, condition or deny a development pro-
posal based on the requirements of this title
may be appealed in accordance with the appeal
procedures and standards applicable to the
subject development permit or approval. [Ord.

20.15B.180 Severability.
If any provision of this chapter or its appli-
cation to any person or property is held invalid,
the remainder of the chapter or the application
of the provision to other persons or property

This chapter shall be liberally construed to
give full effect to the objectives and purposes

20.18.010 Purpose.
The purpose of this chapter is to provide an
informational process supplemental to state
licensing and regulatory procedures to inform
the citizens of residential neighborhoods when
group homes are established and operated
within their boundaries. [Ord. 3184 § 3, 1998].
20.18.020 Pre -establishment operating
plan.
A. As a prerequisite to the primary use
established by ECDC 16.30.010(A)(4) a group
home (facility) shall provide an operating
statement to the director of community ser-
vices 30 days prior to the date on which it plans
to commence operations. "Commence opera-
tions" shall mean the first day during which it
receives a client for residence at the facility.
B. Operating Plan. The operating plan shall
include, but is not limited to, the following:
1. A complete description of the facili-
ties, its clients, staff and operating structure, its
proposed operating conditions and the terms
and conditions of any state license required for
its operation.
2. A statement regarding how the pro-
posed facility furthers the purposes and guide-
lines of the county -wide planning policies
promulgated by Snohomish County and the
comprehensive plan of the city of Edmonds.
3. A financial statement and staffing
plan for the proposed facility, including but not
limited to the manner and method by which
clients are referred to, accepted to and/or
ordered to take up residence at the facility.

4. The addressed of each funding,
licensing or operating entity involved in the
operation.
5. City business license and fire inspec-
tion.
C. The director of community services
shall review the statement for accuracy, com-
pleteness and objectivity before releasing it to
the public. An informational meeting shall be
scheduled 20 days after the director of commu-
nity services provides written notification to
persons residing within 300 feet of the facility
of the availability of the statement for review
by the public. Such informational meeting
shall be held at the convenience of the neigh-
borhood in a location convenient to its resi-
dents.
D. Information Meeting. The director of
community services (or his or her designee)
shall conduct the informational meeting with a
representative of the group home and the resi-
dents of the neighborhood. Notices of the
meeting and an invitation to attend it shall be
provided to all entities shown on the operating
plan as providing substantial contributions to
the group home or licensing its operations. The
director of community services shall make
every effort to encourage the attendance of
such funding and licensing representatives.
E. Nothing herein shall be interpreted to
prohibit a group home from enjoying its pri-
mary permitted use rights vested under this
code. [Ord. 3184 § 3, 1998].
20.18.030 Complaint procedures and
facilitated meeting.
In the event that the city received com-
plaints of persons residing at three or more res-
idences located within 300 feet of the facility,
the director of community services shall
schedule a public meeting under the notice
procedures of the preceding section, making
every reasonable effort to secure the atten-
dance of those entities shown as licensing and
funding the group home under its operating
plan. The meeting shall be conducted as a
community service by the city to facilitate the
understanding of the community regarding the
operations of the facility and to provide a con-
venient forum for members of the neighbor-
hood in which the group home is located to
express their concerns regarding its mainte-
nance, upkeep, or operations to the appropriate
operating, funding and licensing entities. The
city's role shall be to facilitate the sharing of
information and nothing herein shall be inter-
preted as authorization to block the entry of a
properly licensed state facility into a neighbor-
hood; provided, however, that halfway houses
are not permitted uses in any residential zone
of the city and these provisions are not a limi-
tation of the city's other zoning powers with
regard to such halfway houses. [Ord. 3184 § 3,

20.18.040 Neighborhood mediation.
Operators of group homes and members of
neighborhoods are encouraged to utilize the
offices of Snohomish County neighborhood
dispute resolution center in the event that rea-
sonable dialogue between neighbors and facil-
ities cannot resolve the problems inherent in or
attendant to their operation. [Ord. 3184 § 3,

20.18.050 Civil enforcement procedure.
Failure to file a pre -establishment plan as
provided in ECDC 20.18.020 shall be a civil
violation subject to enforcement pursuant to

Land which has specific air, surface, or sub-
surface rights conveyed for use by an entity
other than the owner of the subject property or
to benefit some property other than the subject

21.25.020 Equipment shelter or cabinet.
Equipment shelter or cabinet is a room, cab-
inet or building used to house equipment for
utility or service providers (see Title 22, Plates
1 — 4). [Ord. 3099 § 6, 1996].
21.25.100 Expressive dance.
Expressive dance means any dance which,
when considered in the context of the entire
performance, constitutes an expression of art,
theme, story or ideas, but excluding any dance
such as, but not limited to, common barroom -
type topless dancing which, when considered
in the context of the entire performance, is pre-
sented primarily as a means of displaying
nudity as a sales device or for other commer-
cial exploitation without substantial expres-
sion of theme, story or ideas, and the conduct
appeals to the prurient interest, depicts sexual
conduct in a patently offensive way and lacks
serious literary, artistic, political or scientific

21.30.010 Families.
A. Family means individuals consisting of
two or more persons related by genetics, adop-
tion, or marriage, or a group of five or fewer
persons who are not related by genetics, adop-
tion, or marriage and none of whom are wards
of the court unless such wards are related by
genetics, adoption, or marriage to all of the
members of such group living in a dwelling
unit.
B. The term "family" shall include:
1. State licensed adult family homes
required to be recognized as residential use
pursuant to RCW 70.128.180;
2. State licensed foster family homes
and group care facilities as defined in RCW
74.15.180, subject to exclusion C below;
3. Group homes for the disabled required
to be accommodated as residential uses pursu-
ant to the Fair Housing Act amendments as the
same exists or is hereafter amended.
C. The term "family" shall exclude individ-
uals residing in halfway houses, crisis residen-
tial centers as defined in RCW 74.15.020(3)(g),
group homes licensed for juvenile offenders, or
other facilities, whether or not licensed by the
state, where individuals are incarcerated or oth-
erwise required to reside pursuant to court
order under the supervision of paid staff and

21.30.020
21.30.020 Fence.
Fence means any construction of wood,
metal, masonry or other material which pro-
vides a visual and/or physical obstruction to an
observer at ground level. This definition shall
exclude any portion of a retaining wall which
is below finished grade and which is contigu-
ous with the fence. Any portion of a base or
foundation for the fence which does not serve
a necessary and bona fide purpose of retaining
earth shall not be considered a retaining wall
but rather a part of the fence. [Ord. 2772 § 2,

21.30.030 Flag lot.
Flag lot means a lot which has a frontage of
less than one-half of the minimum lot width on
the principal street or principal access ease-
ment. Flag lots are also known as pipestem lots
or panhandle lots. (See also, Lot.)
21.30.035 Float, recreational.
A recreational float is an offshore platform
used for water -dependent activities such as
swimming and diving. [Ord. 2605 § 4, 1987].
21.30.040 Floor area.
Floor area means the sum of the gross hori-
zontal areas of the floors of a building or build-
ings, measured from the exterior faces of
exterior walls and from the centerline of divi-
sion walls. Floor area shall include: basement
space, elevator shafts and stairwell at each
floor, mechanical equipment rooms or attic
spaces with headroom of seven feet six inches
or more, penthouse floors, interior balconies
and mezzanines, and enclosed porches. Floor
area shall not include: accessory water tanks
and cooling towers, mechanical equipment or
attic spaces with headroom of less than seven
feet six inches, exterior steps or stairs, terraces,
breezeways, and open spaces.
21.30.050 Formal subdivision.

21.30.060 Foster home.
Foster home means a social service facility
licensed by the state as a full-time foster family
and described as an agency which regularly
provides on a 24-hour basis to one or more
individuals, but not more than six individuals.

21.30.070 Fraternity.
Fraternity means a building occupied by and
maintained exclusively for students affiliated
with an academic or professional college or
university, or other recognized institution of
higher learning and regulated in some part by
that institution.
21.30.080 Freestanding sign.
Freestanding sign means a sign not attached

21.35.017 Ground floor.
The ground floor of a structure is that floor
which is closest in elevation to the finished
grade along the width of the side of the struc-
ture that is principally oriented to the street
which provides primary access to the subject
property. A structure consisting of a building
with multiple entrances divided into individual
offices and related uses shall have only one
ground floor. In the event that the use of the
building shifts traffic from one entrance to
another or there is uncertainty in determining
which entrance provides "primary access," the
primary entrance as established by the historic
use of the structure shall control unless the
transfer of the "primary access" from one
street orientation to another is brought about in
conjunction with the building or its use being
brought into full compliance with all current

21.35.020 Group sign.
Group sign means a sign or signs on one
sign structure serving two or more businesses
sharing a parking facility.
21.35.030 Guest house.
Guest house means a detached structure
with not more than two bedrooms, accessory to
a single-family dwelling, having no kitchen
facilities, used primarily for sleeping quarters,
not occupied by paying tenants, and located on
a lot of at least 20,000 square feet in area.
21.35.040 Guyed tower.
Guyed tower is a wireless communication
support structure which is usually over 100
feet tall, which consists of metal crossed strips
or bars and is steadied by wire guys in a radial
pattern around the tower. Guyed towers are
often constructed in rural areas and are used to
support antennas and related equipment. [Ord.

A halfway house shall include state licensed

licensed by the state where alcohol and drug
abusers can be placed in lieu of incarceration
for detoxification and treatment from the

21.40.010 Hearing examiner.
Hearing examiner means the person
employed by the city of Edmonds to hold hear-
ings and make recommendations or decisions
on various land use applications.
21.40.020 Hedge.
Hedge means a fence or boundary formed
by a dense row of shrubs or low trees.
21.40.030 Height.
Height means the average vertical distance,
from the average level of the undisturbed soil
of the site covered by a structure, to the highest
point of the structure, excluding the following:
A. Church steeples;
B. Elevator penthouses, not to exceed 72
square feet in horizontal section, or three feet
in height, for that portion above the height
limit;
