A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, AUTHORIZING DISPOSITION OF
STORM AND SEWER UTILITY EASEMENTS LOCATED ON THE
SOUTH SIDE OF 236TH STREET SW, APPROXIMATELY 176 FEET
EAST OF HIGHWAY 99 IN EDMONDS, WASHINGTON.
WHEREAS, the City of Edmonds is reviewing a development application for property located at
the southeast corner of Highway 99 and 2361h Street SW, consisting of tax parcel
numbers 00451900100201, -202, -203, and -204 (collectively the "Subject Property");
and
WHEREAS, in 1962, the city acquired storm and sewer utility easements, recorded under
auditor's file numbers 1588234 and 1588238 (collectively the "Utility Easements"); and
WHEREAS, the Utility Easements were declared surplus with Resolution 1505; and
WHEREAS, RCW 35.94.040 provides a process for disposing of surplus utility property; and
WHEREAS, RCW 35.94.040 requires the disposition resolution to state the fair market value or
the rent or consideration to be paid and such other terms and conditions for such
disposition as the legislative authority deems to be in the best public interest; and
WHEREAS, the appraised value of the 1000 square foot area encumbered by the Utility
Easements is $86,250; and
WHEREAS, the project proposed for development on the subject property will provide the
following new easements to the City: 1) a public pedestrian easement will be granted to
the City for that portion of the sidewalk to be constructed on private property; and 2) a
public water meter vault easement will also be provided on private property along the
Highway 99 property frontage; and
WHEREAS, the new easements being provided to the city amount to 2876 square feet, which is
substantially more area than the 1000 square foot Utility Easements proposed for
disposition; and
WHEREAS, staff is recommending that the new easements provide sufficient consideration for
the disposition of the Utility Easements and that no other money should be required as a
condition of the disposition; and
WHEREAS, on September 27, 2022, a public hearing was held on the proposed disposition of
the Utility Easements; and
WHEREAS, the city council, after hearing the staff presentation and the testimony provided at
the public hearing would like to dispose of the Utility Easements in the manner described
below; now therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
Section 1. The administration is hereby authorized to dispose of the Utility Easements described
above by releasing and reconveying them to the property owner in exchange for, and after receipt
of, the new easements described above.
