AN ORDINANCE OF THE CITY OF EDMONDS
REPEALING ORDINANCE 4079, WHICH CREATED A
SEPA PLANNED ACTION WITHIN THE CITY'S
HIGHWAY 99 SUBAREA.
WHEREAS, the city council adopted Ordinance 4079, a planned action ordinance
under RCW 43.21C.440, on August 15, 2023; and
WHEREAS, Section 5.A of Ordinance 4079 stated: "The City shall monitor the
progress of development in the designated Planned Action Sub-area to ensure that it is
consistent with the assumptions of this ordinance and the Planned Action EIS regarding the
type and amount of development and associated impacts, and with the mitigation measures
and improvements planned for the Highway 99 Planned Action Area;" and
WHEREAS, the city council has concerns about whether the mitigation measures in
the Planned Action EIS are adequate; and
WHEREAS, there will be an opportunity to revisit the subarea, including the utility
and desirability of using a planned action in the subarea, in conjunction with the 2024
comprehensive plan update; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section I. Repealer. Ordinance 4079 is hereby repealed.
Section 2. Severability. If any section, subsection, clause, sentence, or phrase of this
ordinance should be held invalid or unconstitutional, such decision shall not affect the
validity of the remaining portions of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifically
delegated to the City legislative body, is not subject to referendum and shall take effect five
(5) days after passage and publication of an approved summary thereof consisting of the
title.
