Commission, the Edmonds City Council meeting was called to order at 7:02 p.m. by Mayor Haakenson in the Council Chambers, 250 5th Avenue North, Edmonds. The meeting was opened with the flag salute. INTRODUCTION OF HISTORIC PRESERVATION COMMISSION MEMBERS Historic Preservation Commission Historic Preservation Commission. President Steve Waite introduced the two newest members of the Commission, one filling a vacancy and the other a new member to bring the total membership of the Commission to seven, Deborah Binder and Brian Hall. He also described Ms. Binder and Mr. Hall's backgrounds. ECDC 3B. PUBLIC HEARING ON ORDINANCE NO. 3522 AN INTERIM ZONING ORDINANCE Definitions of Setbacks AMENDING THE EDMONDS COMMUNITY DEVELOPMENT CODE DEFINITIONS OF SETBACKS (SETBACK, SIDE SETBACK, REAR SETBACK, STREET SETBACK). Development Services Director Duane Bowman explained this was a result of the tree house issue that had included discussion regarding how the code applied to structures in the side setback. The Council adopted an interim ordinance to put back in place the City's regulation of structures in the side, rear and street setbacks to give the Planning Board an opportunity to consider the issue and develop a recommendation regarding play structures, exceptions in the setback, etc. Mr. Bowman advised this was a public hearing to take public testimony to be forwarded b the Planning Board for their review and recommendation to the Council in early 2005. Mayor Haakenson opened the public participation portion of the public hearing. There were no members of the public who wished to provide testimony and Mayor Haakenson closed the public hearing and remanded the matter to Council for action. Council President Plunkett provided a reminder that this was an interim ordinance; the issue of setbacks would be taken up in greater detail by the Planning Board where the public would have opportunity to provide input. COUNCIL PRESIDENT PLUNKETT MOVED, SECONDED BY COUNCILMEMBER WILSON, FOR ADOPTION OF THE INTERIM ORDINANCE. MOTION CARRIED UNANIMOUSLY. Edmonds City Council Approved Minutes December 7, 2004 Page 2 Mr. Bowman clarified the Council had previously adopted the interim ordinance which also referred the matter to the Planning Board. This was an opportunity for the Council to provide any additional direction for consideration by the Planning Board. First Baptist 4. PUBLIC HEARING ON A RECOMMENDATION BY THE EDMONDS HISTORIC Church of PRESERVATION COMMISSION TO DESIGNATE THE FIRST BAPTIST CHURCH OF Edmonds / EDMONDS AS ELIGIBLE FOR LISTING ON THE EDMONDS REGISTER OF HISTORIC Register of Historic PLACES. THE SITE IS ADDRESSED AS 404 BELL STREET AND IS ZONED COMMUNITY Places I BUSINESS (BC). (FILE NO. HP-03-114 Planning Manager Rob Chave advised this was a public hearing on a recommendation by the Historic Preservation. Commission to designate the First Baptist Church of Edmonds, 404 Bell Street, as eligible for listing on the Edmonds Register of Historic Places. After considering all the information, the Commission recommended the Council approve the potential designation. He explained before the property could be listed, the property owner would need to indicate their willingness to be included in the Register. If they concurred, an ordinance would be presented to the City Council to list the property on the Edmonds Register of Historic Places. Mr. Chave referred to the Historic Preservation Commission's recommendation on page 4 of the Council packet and their recognition of the church's features listed on pages 3 and 4 of the packet. He summarized this was a public hearing for the Council to take public testimony to assist in making their decision regarding whether to designate the property as eligible for listing. Councilmember Dawson asked whether any input had been solicited from the church. Mr. Chave advised representatives of the church attended the Historic Preservation Commission meetings and seemed positively inclined but had not yet made a decision. Pastor Barry Crane, First Baptist Church, now known as the North Sound Church, 404 Bell Street, thanked the Historic Preservation Commission for their efforts to identify the church for potential designation on the Edmonds Register of Historic Places. He recognized Historic Preservation Commission President Steve Waite for his efforts leading the Commission and working with the church, Council President for Plunkett for meeting with him to discuss the process, and Planner Star Campbell for her efforts. He expressed his thanks to the members of the Historic Preservation Commission for their efforts with regard to the application process. He advised he was available to answer questions. Hearing no further public comment, Mayor Haakenson closed the public hearing. Council. President Plunkett commented on how open. Pastor Crane and the church members were to considering the designation. He noted that although some may be apprehensive when government indicates a desire to designate their property, the church has been very open and willing in discussing with the Historic Preservation Commission the possibility of historic designation. COUNCIL PRESIDENT PLUNKETT MOVED, SECONDED BY COUNCILMEMBER OLSON, THAT THE COUNCIL FIND THAT THE EDMONDS BAPTIST CHURCH MEETS THE CRITERIA CONTAINED IN CHAPTER 20.45.010 ECDC, AND AUTHORIZE THE MAYOR AND STAFF TO EXECUTE SUCH DOCUMENTATION AS NECESSARY TO CONFIRM THE CITY COUNCIL'S APPROVAL OF THE SITE FOR LISTING ON THE EDMONDS REGISTER OF HISTORIC PLACES. MOTION CARRIED UNANIMOUSLY. AUDIENCE COMMENTS Building Ron Wambolt, 530 Dayton Street, Edmonds, pointed out the Downtown Waterfront Plan update states eights higher building height could produce over 1000 new dwelling units in the downtown area, an action he Edmonds City Council Approved Minutes December 7, 2004 Page 3 felt would negatively affect downtown. The update also states the alternative was to find capacity for another 636 dwelling units elsewhere in the City which the update states would change the character of the single family neighborhoods. He noted there was no mention in the update regarding the impact 1000 new dwelling units would have on the downtown area. He urged viewers who did not want walls of buildings downtown to attend the December 15 Planning Board public hearing and comment on the Downtown. Waterfront Plan. He recalled a small group of citizens collected over 1000 signatures opposed to the changes; an effort that has been belittled by supporters who feel 1000 is only a small sampling of the 40,000 residents of Edmonds. He commented that based on the group's experience soliciting signatures, it was likely at least 39,000 signatures could be obtained if the entire City were canvassed. He questioned whether a comparable list of signatures had been obtained of residents who supported higher building heights. Planning Don Kreiman, 24006 95th Place W, Edmonds, commented the Planning Board has taken a great deal of Board Public testimony, and the December 15 public hearing was the final opportunity for comment to the Planning Hearing copn Board on the Comprehensive Plan. He urged the public to attend the December 15 meeting, pointing out he Comp. p g P $� P g Plan this was an important issue due to the potential to increase the economic viability of the City. He commended the Mayor and Council for doing a phenomenal job this year, remarking the Council had passed laws this year that would have an impact on the City for a long time. He pointed out that what the Council did at the beginning of next year would be equally as important. Roger Hertrich, 1020 Puget Drive, Edmonds, questioned why a public hearing was necessary when it Building appeared Planning Board Members had their minds made up with regard to 33-foot building heights. He Heights referred to a conversation he had with Planning Board member Jim Crim, who reiterated that 1000 signatures was not representative of the 40,000 Edmonds residents. He noted what attracted people to Edmonds was a combination of the waterfront, character of downtown, the shape of the bowl and the views. He urged the public to attend the December 15 Planning Board meeting where the issue of building heights would be discussed. He expressed concern with the discussion regarding height averaging for the former Safeway property and the Harbor Square property, commenting that a structure on the waterfront that was higher than allowable building heights was being used as an excuse for an averaging method for the property to the east. He pointed out the potential for five floors and 50-60 foot tall towers. He concluded this was an 8-foot increase to the building height, not a 3-foot increase because the maximum height was actually 25 feet plus 5 feet; an increase to 33 feet was an 8-foot increase. Gardan Tour Stephen Clifton, Chair of the 2005 Edmonds in Bloom Garden Tour, announced the 2005 tour was scheduled for Sunday, July 15, 2005. He explained that 7-9 gardens were needed for the tour and invited residents within the city limits of Edmonds or Woodway who had an eclectic, colorful, informal or formal garden to contact him to learn how to be included on the tour at 206-533-2076 or via email at Clifton—Edmonds@msn.com. MAYOR'S COMMENTS Mayor Haakenson commented Police Chief David Stern had taken the night off to celebrate his 40th wedding anniversary. Mayor Haakenson congratulated Chief Stern and his wife. Mayor Haakenson wished everyone Happy Holidays. COUNCIL COMMENTS Mukilteo Council. President Plunkett advised he would be sending Councilmembers a draft resolution regarding Flyovers Mukilteo flyovers and asked they submit any comments/suggestions to Senior Executive Council. Assistant Jana Spellman to be incorporated into a draft resolution for Council consideration. Edmonds City Council Approved Minutes December 7, 2004 Page 4 Councilmember Moore reported on a Community Transit Board meeting she attended where the Board mmunity approved their budget and also discussed the rollout of a branding campaign in January that will include a nsit pP g g p Zm D' new logo. She reported on the Government Economic Development Forum that Councilmember Olson and she attended, the third annual Governor Locke forum, where they learned broadband communications was the key to economic development in communities. She noted Edmonds was ahead of other communities in that regard due to the creation of the Community Technology Advisory Board. The group agreed on the following items to present to the Legislature, 1) a statewide gas tax increase with local distribution, 2) statewide gas tax increase for the major corridors, 3) additional funding options for local governments, and 4) endorsement for the hot lane project on SR-167, a pilot project to charge a toll for the use of HOV lanes. shop Councilmember Moore read from the Bowl Banter, a Downtown Merchant Association newsletter, which ILocally reported shopping at a local store versus a chain store helped the local economy because those merchants paid for services locally, putting dollars back into the community. In addition local stores hire local workers who in turn spend their wages locally. Local stores contribute to the local decision -making process by participating in business, educational and civic organizations and donate to and promote local causes. Councilmember Moore urged residents to shop locally this holiday season. Councilmember Moore expressed her thanks to the Council for their patience with her, noting these Councilmembers were among the most committed and intelligent public servants she has seen. She expressed her thanks to the Mayor and his staff for their professionalism, decency and patience with her learning curve this year. She thanked the people of Edmonds for giving her their public trust and wished everyone a Happy Holliday. Councilmember Olson explained one of the reasons it was important to identify funding options for transportation projects was because cities no longer had money for street repairs, evidenced by Edmonds 60-year overlay cycle. She expressed her thanks for all the support and assistance with her learning curve over the past year. Councilmember Dawson advised she would be absent from the December 14 Council meeting. She wished the Council, staff and public a Happy Holiday. Councilmember Wilson wished everyone a Happy Holiday, thanking the public for the comments they offer and their continued efforts to keep the Council informed. Council President Plunkett stated there are Council Committee meetings next week beginning at 6:00 p.m. followed by a short Council meeting. Councilmember Moore advised the December 15 Planning Board public hearing would be televised on Channel 21. Mayor Haakenson wished Ms. Spellman a belated Happy Birthday.
