Resolution 1119RESOLUTION NO. 1119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DECLARING THE PROVISION OF SEWER LIFT STATION TELEMETRY EQUIPMENT TO BE APPROPRIATE FOR SOLE SOURCE PROCUREMENT AND APPROVING THE USE OF SUCH PROCESS. WHEREAS, the City's purchasing policies and procedures require competitive bids for procurement of goods and services exceeding $5,000 in cost, and, WHEREAS, the City has a requirement to upgrade its sewer lift station telemetry system, and, WHEREAS, a sewer lift station telemetry system meets the definition of pollution control "facility" in RCW 70.95A.020, and, WHEREAS, RCW 70.95A.090 reserves to local governing bodies the sole discretion to improve pollution control facilities and waives requirements for competitive bidding and other restrictions imposed on procedure for awarding contracts for such purpose, and, WHEREAS, such upgrade will require the professional services of a consulting firm to provide design, engineering, programming, equipment installation, and other services, and, WHEREAS, in 1997 the City engaged the services of a consulting engineering firm to upgrade the water utility telemetry equipment, and, WHEREAS, the City utilized the professional services consultant selection process to select the consulting engineering firm in 1997, and WHEREAS, the process resulted in a contract to both design the telemetry system as well as install the equipment, and WHEREAS, the engineering and public works departments have recommended that the sewer lift station telemetry equipment be upgraded because it is beginning to fail and requires replacement, and WHEREAS, within the telemetry system industry, each engineering firm has their own unique and proprietary way of designing each system, and WHEREAS, the City staff has recommended that from an operational standpoint, the City utilize the same telemetry system throughout the water and sewer utilities in order to reduce the cost of maintenance and operations, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council finds that the proprietary nature of the design and installation of telemetry equipment creates special market standards and conditions which justify the use of sole source procurement. Accordingly, the City Council authorizes the Public Works Department to utilize the sole source selection process for the design, procurement and installation of a telemetry system within its sewer utility, upon the certification of the selected engineering consultant that the telemetry system to be installed is proprietary and that the price charged the City is consistent with the lowest prices offered by the consultant for such design and installation services to other similarly situated customers.
