Resolution 10610006.90000 WSS/gjz 3/03/04 RESOLUTION NO.1061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, AMENDING AND ESTABLISHING FEES FOR INSTALLATION OF AN AMATEUR RADIO ANTENNA, A REQUEST FOR WAIVER FOR TECHNOLOGICAL IMPRACTIBILITY RELATING TO SUCH AN ANTENNA AND FOR A NEIGHBORHOOD APPLICATION TO REVIEW LESS BURDENSOME ALTERNATIVES. WHEREAS, PRB-1, a regulation of the Federal Communications Commission, requires cities to accommodate amateur radio antennas and prohibits undue burden; and, WHEREAS, the City Council has separately enacted amendments to ECDC 16.20.050 relating to amateur radio antennas to better accommodate these structures, to provide for an interactive process to consider waivers for technological impracticability and to lessen impacts upon the neighborhood by considering less burdensome alternatives; and WHEREAS, the City Council deems it to be in the public interest to establish fees for these processes which are set at levels lower than the actual full cost of conducting the review thereby encouraging both amateur radio operators to fully utilize the rights granted them by the FCC and to provide for an interactive process which considers a number of concerns, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City's fee structure is hereby amended to provide for the following amended and/or new fees: {WSS564921.DOC;1/00006.900000/1 - 1 - A. Application to install an amateur radio - antenna pursuant to ECDC 16.20.050(E) $97 B. Request for waiver -technological impracticability pursuant to ECDC 16.20.050(F) $97 C. Application for interactive process to consider less burdensome alternatives pursuant to ECDC 16.20.050(F)(2) $97 These fees shall be in full force and effect from and after the date of passage of this resolution.
