A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, ACCEPTING THE DEDICATION
OF AN INTEREST IN REAL PROPERTY CONTAINED IN A
SHORT SUBDIVISION APPROVAL, LOCATED AT 21506 —
96' AVENUE WEST.
WHEREAS, Chapter 20.75 of the Edmonds Community Development Code
(ECDC) authorizes the Community Services Director or his/her designee to approve applications
for short subdivisions; and
WHEREAS, ECDC 20.75.158 requires City Council acceptance of any dedicated
interest in real property contained in a short subdivision; and,
WHEREAS, the City has approved Edmonds Short Subdivision File No. S-02-
204, located at 21506 — 96th Avenue West within the City of Edmonds, Washington; and
WHEREAS, said short subdivision contains a proposed dedication of an interest
in real property as legally described on the attached Exhibit A, incorporated herein by this
reference as if set forth in full; and
WHEREAS, the City Council desires to approve the dedication referenced herein
in accordance with applicable City regulations, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:

Section 1. The proposed dedication of the real property interest contained in the
short subdivision referenced above and legally described in Exhibit A is hereby formally
accepted.
Section 2. The acceptance expressed herein shall not stay any approval, appeal
deadline or the effective date of the short subdivision at issue.

WHEREAS, the Grantors, Helleren Development Company, owners of that portion of the Northwest
'/ of the Northeast'/ of Section 25, Township 27N, Range 3E., W.M. situated in the County of
Snohomish, State of Washington described as follows:
Beginning at the Southeast corner of the said Northwest Quarter; thence N88*52'27"W 30 feet;
thence N 0*35'56"E 146 feet to the True Point of Beginning (TPOB); thence N88*52-27"W 297.15
feet; thence NO*34'55"E 146 feet; thence S88*5227' W 297.21 feet; thence SO*35'56"W 146 feet to
the TPOB.
(being known as Tract 3, ONAVU Park Division 1, according to the unrecorded plat thereof)
NOW THEREFORE, Grantors hereby declare and dedicate forever, to the City of Edmonds for public
use the following described property:
Beginning at the said True Point of Beginning; thence N88*52'27"W 297.15 feet; thence N00* 34'55"E
20.00 feet; thence S88*52'27"E 276.98 feet to a point of curve to the left; thence Easterly along said
curve through a central angle of 90*32'37", a length of curve of 31.61 feet to the point of tangency
and Westerly right-of-way margin of 96th Ave W; thence S00*35'56"W 40 feet more or less to the True
Point of Beginning.
