RESOLUTION NO. 961
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, REQUESTING A PETITION FOR
AN ORDER OF DISSOLUTION BE PREPARED FOR FILING
IN SNOHOMISH COUNTY SUPERIOR COURT TO
DISSOLVE THE CULTURAL ARTS STADIUM AND
CONVENTION DISTRICT, AND FURTHER RESOLVING TO
AUTHORIZE AND DIRECT THE MAYOR TO EXECUTE
SAID PETITION ON BEHALF OF THE MAJORITY OF THE
EDMONDS LEGISLATIVE BODY.
WHEREAS, in 1982, legislation known as RCW Chapter 67.38 was passed to
allow creation of a Cultural Arts Stadium and Convention District ( "District "), and,
WHEREAS, such a District was formed in South Snohomish County which
includes the cities of Brier, Mountlake Terrace, Woodway, portions of Mill Creek, as well as a
portion of unincorporated area within surrounding each city, primarily within the Edmonds
School District; and
WHEREAS, a governing body was formed in accordance with RCW 67.38.050,
and a plan was developed which was submitted as a ballot issue in 1986 to the voters of the
District and failed to receive voter approval; and
WHEREAS, in 1988, another plan was submitted to the District voters and failed
to receive approval; and
WHEREAS, in May of 1998, the governing body submitted a plan to the District
voters for approval to fund a Cultural Arts Stadium and Convention facility through a special
property tax levy; and

WHEREAS, the proposed financing plan for such a facility was rejected by the
voters by an overwhelming seventy -five percent (75 %) majority of the votes cast within the
District; and
WHEREAS, in 1999, legislation known as Senate Bill 5385, Chapter 254, Laws
of 1999, effective July 25, 1999, provides for an alternate method of dissolving and liquidating
the affairs of cultural arts stadium and convention districts established in accordance with that
chapter; and
WHEREAS, dissolution of the District may now be accomplished by a petition
signed by at least two - thirds (2/3) of the legislative bodies who have representatives on the
District governing body for an order of dissolution to the superior court of a county of the
District where all the signatures are obtained within one hundred twenty (120) days of date of
submitting the petition to the court. Now Therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City of Edmonds petitions Snohomish County and /or the
governing body of the Cultural Arts Stadium and Convention District to prepare a petition for an
order of dissolution to dissolve the Cultural Arts Stadium and Convention District to be filed
with Snohomish County Superior Court after obtaining the necessary signatures.
Section 2. Mayor Barbara Fahey is hereby authorized and directed to execute said
petition on behalf of the majority of the legislative body of the City of Edmonds.
