RESOLUTION NO. 859
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, INITIATING A VACATION AND
FIXING A TIME FOR A PUBLIC HEARING REGARDING
THE PROPOSED VACATION.
WHEREAS, the City staff has reported that an easement for the construction and
maintenance of improvements as part of the stream channel restoration of Shell Creek was
granted without consideration to the City by William V. Phillips and Joanne F. Phillips; and
WHEREAS, the City staff has reported to the City Council that this easement is
surplus to the needs of the City; and
WHEREAS, the City Council wishes to initiate the vacation process established
pursuant to ECDC Chapter 20.70, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Council hereby initiates the vacation process for a
construction and maintenance easement for the purposes of stream channel restoration in Shell
Creek. The easement is dated March 23, 1989 and recorded in Volume 2318, page 1393 in the
records of Snohomish County as document number 9003150308.

Section 2. The City Council hereby establishes as a date for public hearing the
21st day of January, 1997. Such date is less than 60 days and more than 20 days after the date
of passage of this Resolution.
