RESOLUTION NO. 814
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, ESTABLISHING A
MORATORIUM ON BUSINESS LICENSES, BUILDING
PERMITS AND OTHER FORMS OF DEVELOPMENT PERMITS
WITH REGARD TO ADULT ENTERTAINMENT, . AND
PROVIDING FOR AN AUTOMATIC EXPIRATION OF THE
MORATORIUM UNLESS EXTENDED PURSUANT TO PUBLIC
HEARING.
WHEREAS, the City of Edmonds currently prohibits
establishment of so called adult entertainment uses within the City
of Edmonds, and
WHEREAS, the Council has for many months been considering
amendment of its ordinance in order to incorporate a regional
approach to the issue; to consider studies and other information
developed by adjacent entities and in order to review the problem
in light of the Growth Management Act; and
WHEREAS, the City has entered into an interlocal
agreement to study the issue of adult entertainment in light of
regional planning and in order to review various regional
approaches which may be available under the Growth Management Act;
and
WHEREAS, during the pendency of the study, the City
Council finds it to be in the public interest to prohibit
application for development permits of any kind by adult
entertainment facilities under existing City ordinance, in order to
prevent the vesting of rights under such ordinance until such time

as the regional study has been completed and the City Council has
an opportunity to finally review any proposed changes to its codes
in light of the recommendation of the City's Planning Board, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. A moratorium is hereby declared on
applications by adult bookstores, adult entertainment centers, and
adult motion pictures theaters as the same are defined in Ordinance
2279 as codified and any other related so called adult
entertainment use for business licenses, building permits,
conditional use permits or any other development permit of any kind
or nature.
Section 2. This moratorium shall continue in full force
and effect for a period of six months from the date of passage
hereof. It shall automatically expire on that date unless extended
pursuant to public hearing. The moratorium is intended to, run
concurrently with an interlocal review of regional regulation of
such so called adult entertainment uses and the City Council hereby
states its intent to repeal such moratorium at such time as a
regional approach is adopted pursuant to Snohomish County
ordinance, state law or revisions to the Edmonds Community
Development Code or extend the moratorium until such events occur.
Section 3. In accordance with the requirements of
Chapter 207 of the laws of 1992, a public hearing on this

moratorium is set for June 6 , 1995 , such date being within sixty

(60) days of the passage of this moratorium.
