RESOLUTION NO. 784
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, DECLARING AN EMERGENCY
NECESSITATING SUSPENSION OF NORMAL BID
PROCEDURES IN ORDER TO NEGOTIATE EXPEDITED
CONTRACTS TO INVESTIGATE AND REPAIR DAMAGE TO
THE EXTERIOR WALL OF THE WASTE WATER TREATMENT
PLANT INCINERATOR.
WHEREAS, on January 24, 1994 a crack of approximately 14
inches was discovered in the exterior wall of the incinerator at
the Waste Water Treatment Plant and,
WHEREAS, the disposal of sewage through the Waste Water
Treatment Plant effects the health, safety and welfare of not only
the City of Edmonds but also other cities whose waste water is
treated at the facility, and
WHEREAS, immediate investigation of the damage to the
incinerator is required as well as repair of the facility through
public works and professional service contracts, and
WHEREAS, such. expedited contracts could potentially
violate provisions of the Washington State Bid Laws as well as its
small work roster provisions, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Council hereby finds that the
investigation and repair of the incinerator at the Waste Water
Treatment Plan constitutes an emergency in that the failure to

immediately investigate and correct the situation could potentially
result in the effected public entities incurring claims, loss or
liability due to potential future violation of pollution control
law as well as degradation of the environment and the public
health, safety and welfare. Based upon such emergency, the City
Council hereby authorizes deviation form the small works roster
provisions adopted by the City pursuant to RCW 35.22.620(7) and the
general bid laws of the State of Washington and the City of
Edmonds.
Section 2. The Mayor through designated staff is hereby
authorized to deviate from said provisions of the small works
roster and bid laws, but is requested to utilize such procedures as
a guide to the extent practical and consistent with emergency
repairs, in order to obtain the best possible price for such
investigation and repairs.
