Resolution 7850006.090.084 MA /are 01/25/94 Rev: 02/01/94 RESOLUTION NO. 785 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, ESTABLISHING A DATE AND TIME FOR A PUBLIC HEARING TO CONSIDER THE FORMATION OF A LOCAL IMPROVEMENT DISTRICT TO BE DESIGNATED LID NO. 214, PURSUANT TO THE RESOLUTION METHOD, FOR THE PURPOSE OF MAKING STORM SEWER AND ROAD WAY IMPROVEMENTS TO 204TH STREET SOUTHWEST; 86TH PLACE WEST; MAIN STREET AND MAPLEWOOD DRIVE. WHEREAS, the City intends to form a local improvement district for the purpose of making storm sewer and roadway improvements to 204th Street S.W.; 86th Place West; Main Street and Maplewood Drive as specifically identified on Exhibits A and B attached hereto and incorporated herein by this reference as if set forth in full. WHEREAS, the date, time and place of a public hearing to consider the proposed local improvement district and improvements should be established, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. A public hearing shall be conducted before the Edmonds City Council on February 28, 1994 at 7:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers at Edmonds City Hall, Edmonds, Washington, to consider the formation of a local improvement district for the purpose of making storm sewer and roadway improvements 1 66063.2 to 204th Street S.W.; 86th Place West; Main Street and Maplewood Drive as specifically identified on the Attached Exhibits A and B. Section 2. The preliminary total cost estimate of Proposed LID 214 is approximately $310,000.00. The amount to be assessed will vary depending upon the benefit to the property owner. Both street assessments and storm sewer assessments may be levied. NOTICE IS HEREBY GIVEN THAT THE ACTUAL ASSESSMENTS FOR THE LOCAL IMPROVEMENT DISTRICT MAY VARY FROM ASSESSMENT ESTIMATES SO LONG AS THEY DO NOT EXCEED A FIGURE EQUAL TO THE INCREASED TRUE AND FAIR VALUE THE IMPROVEMENT, OR STREET LIGHTING, ADDS TO THE PROPERTY. Section 2. The City Engineer of the City of Edmonds is hereby directed to submit to the City Council at or prior to the day of the hearing, the estimated cost and expense of the proposed improvements and a statement of the aggregate valuation of the real estate and improvements thereon within the proposed improvement district, according to the last valuation placed on it for general taxation; together with a diagram or print showing thereon the lots, tracts or parcels of land or other property which will be specially benefited thereby, and the estimated amount of the cost and expense of such improvements to be borne by each such lot, tract, parcel or parcels of land or other property. Section 3. All Persons who may desire to speak for or against the proposed local improvement district and improvements herein mentioned are invited to comment in person at the public hearing or to submit written comments to the City Clerk at Edmonds City Hall. 2 66063.2 Section 4. The City Clerk is hereby directed to publish the within Resolution, including Attachments A and B, in two consecutive issues of the City of Edmonds official newspaper; the first date of publication shall be at least fifteen days before the hearing date of February 28, 1994, in accordance with the requirements of RCW 35.43.140. Section 5. The City Clerk is hereby directed to mail a copy of the within Resolution, including Attachments A and B, to the owners or reputed owners of all lots, tracts, and parcels of land or other property which shall be benefited by the proposed LID 214; each notice shall be given at least fifteen days before the hearing date of February 28, 1994.
