RESOLUTION NO. 764
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, AUTHORIZING APPEAL OF
ADOPTION OF SNOHOMISH COUNTY GROWTH MANAGEMENT
POLICIES.
WHEREAS, Snohomish County Council has adopted pursuant to
Chapter 36.70A RCW certain policies pursuant to the Growth
Management Act, and
WHEREAS, certain of those polices imply or could fairly
be interpreted to provide for the exercise of County control over
local zoning measures, in particular the development of policies
and amendments to each individual jurisdiction's comprehensive plan
necessary to implement and accept population pursuant to the Growth
Management Act, and
WHEREAS, RCW 36.70A.210 provides that the adoption of
policies by a County shall not alter the land use powers of local
jurisdictions within its borders, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Attorney is hereby authorized to
initiate an appeal to the Growth Planning Hearings Board in order
to challenge the adoption of policies by Snohomish County which
expressly or impliedly provide for the exercise of authority by
Snohomish County over or with respect to the adoption of policies
and comprehensive plan amendments by the City of Edmonds in

violation of section 36.70A.210 of the Growth Management Act. The
City Attorney is authorized to coordinate such appeal in
conjunction with the City of Lynnwood and other entities which
desire to present the same issue to the Growth Planning Hearings
Board.
Section 2. The City Council further wishes to express to
Snohomish County Council its hope that the policies can be
clarified or amended in order to address the clear and perhaps
unintentional impingement of City zoning authority by the adoption
of the County policies. To that end, the City Council directs that
a copy of this Resolution be forwarded to the Snohomish County
Council and the Mayor, City staff and City Attorney are directed to
continue toward amendment or clarification of the policies in a way
which clarifies the respective authorities of the County and City
under RCW 36.70A.210.
