RESOLUTION NO. 772
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, REQUESTING THE
ASSOCIATION OF WASHINGTON CITIES TO ESTABLISH
AS ONE OF ITS LEGISLATIVE PRIORITIES FOR THE
NEXT . WASHINGTON LEGISLATIVE SESSION THE
ENACTMENT OF A STATUTORY PROVISION WHICH WOULD
ENABLE A CITY COUNCIL TO HIRE A STAFF .PERSON
TO ASSIST IT IN ITS LEGISLATIVE FUNCTION WHO
WOULD REPORT TO THE CITY COUNCIL, HIRED AND
SUBJECT TO ITS DIRECT CONTROL AND APPOIN'T'MENT
AND SERVE AT ITS PLEASURE.
WHEREAS, RCW 35A.12.100 provides in part that the Mayor
shall have the exclusive hiring and firing power in a code city,
and
WHEREAS, the City Council in the course of the
administration of its legislative duties requires the assistance of
an employee to coordinate its activities, prepare its
correspondence and otherwise act to gather material with regard to
the administration of its legislative duties, and
WHEREAS, the City Council desires to be able to hire such
an individual itself directly so that it may maintain a personal,
direct, and confidential relationship with this individual and in
order that the person which holds the job would not be subject to
any conflicts of interest real, or apparent, in the administration
of their duties, and
WHEREAS, because the City Council would closely direct
the activities of this person whose clerical duties would be

indistinguishable from other City employees, the City Council has
been advised that it may not engage. an independent contractor
without violating various provisions of state and federal law, and
WHEREAS, the City Council does not wish to intrude into
administration nor establish a separate administrative structure
apart from that of the City but wishes to be able to hire an
individual or individuals -to perform duties directly related to its
legislative function and to direct, discipline, and if necessary
terminate such individual in its sole discretion, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The Association of Washington cities is
hereby requested to establish as a legislative priority for the
upcoming session of the Washington State Legislature, the enactment
of the amendment to the provisions of RCW Chapter 35+A and RCW
35A.12.100 in order to permit the city council to hire a limited
legislative staff to handle its correspondence, gather information,
and arrange details relating to the fulfillment of its legislative
function.. Such an individual or individuals would serve at the
discretion of the City Council who would have sole authority to
hire, fire, discipline, and direct the employee(&). Such language
might be accomplished by the amendment of RCW 35A.12.090 to add
language similar to that which. follows:
Nothing herein shall be interpreted to
prohibit the City Council from hiring, firing,
disciplining, and directing a limited
legislative staff whose duties shall be
attendant to its legislative functions as

established in this chapter and who would
serve at the sale discretion. of the City
Council.
RCW 35A.12.100 should Cross reference the amendment of RCW
35A.12.100 by adding the language at the end of the first sentence:
...excepting only the City Council's
legislative staff.
