RESOLUTION NO. 710
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, EXTENDING A FRANCHISE
GRANTED TO EDMONDS CABLE COMPANY TO JANUARY 31,
1991 SUBJECT TO CERTAIN CONDITIONS.
WHEREAS, the City of Edmonds and Edmonds Cable Company
have been negotiating in good faith toward a resolution of the
current franchise review process;
WHEREAS, the negotiators reached tentative agreement
which has been presented to the Edmonds City Council and the
Chief Executive Officer of Edmonds Cable;
WHEREAS, Edmonds Cable has requested an extension of
the approval process in order to present to the City a new
technological development, requesting consideration of an
extension of certain franchise term regarding the date by which
the reconstruction of the system must be completed;
WHEREAS, the Council finds it reasonable to consider
the request and the new technology at the request of the
franchisee, so long as the extension is reasonable in length,
noting that the citizens of the City of Edmonds continue to be
inconvenienced by the refusal of the franchisee to add certain
services such as TNT network to the current cable entertainment
package during the pendency of negotiations;

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The cable franchise previously extended to
the franchisee and Edmonds Cable Company is hereby extended to
and through January 31, 1991 subject to the conditions set forth
in paragraph 2.
Section 2. This extension has been made in
consideration of the representation of the cable operator that if
a franchise agreement is reached which provides for an increased
franchise fee, it will retroactively pay an amount equal to the
difference between the current franchise fee and the agreed upon
franchise. The franchisee shall, by its continued operation, be
deemed to accept this condition of extension, but nothing herein
shall be interpreted as requiring the operator to agree to such
an increase.
