Resolution 6904 0006.150.052 WSS /klt 09/07/89 RESOLUTION NO. 690 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, ESTABLISHING A MORATO- RIUM ON THE FILING OF APPLICATIONS FOR ACCESSORY DWELLING UNIT CONDITIONAL USE PERMITS UNDER THE PROVISIONS OF CHAPTER 20.21 OF THE EDMONDS COMMUNITY DEVELOPMENT CODE. WHEREAS, for some years, the City has reviewed applica- tions for accessory dwelling units under the provisions of ECDC Chapter 20.21, and WHEREAS, the City Council acknowledges that practical difficulties have arisen in the application of the ordinance to a specific neighborhood situation and legitimate questions have arisen whether the actual wording of the Chapter is in conformance with the original intent of the Council at the date such ordinance was enacted, and WHEREAS, this matter has been referred to the Planning Board for its review, and said Planning Board is proceeding as expeditiously as possible with a process of public hearings and a recommendation to the City Council, and WHEREAS, the City Council finds that continued processing of applications for accessory dwelling units during the pendency of review could negatively impact property values on single family r sidential neighborhoods and result in undue hardship to roperties adjoining' applicants for accessory dwelling units, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. A moratorium is hereby established on the filing and acceptance of applications for a conditional use permit for accessory dwelling units, filed under the .provisions WSS51693R -1- i of ECDC Chapter 20.21. This moratorium is established immediately upon the passage of this resolution. The City staff shall not accept nor process any such applications during the pendency of the moratorium. Section 2. This moratorium shall be and remain in effect for such period of time as is necessary for the Planning Board to render its decision to the Council and for the Council to review such recommendation, and if the Council in its discretion chooses to hold such additional public hearings as it may determine are necessary to comply with law and ordinance and to finally consider such recommendations and zoning code amend- ments, if any. In no event shall this moratorium extend beyond November 21, 1989, and shall expire on the earlier of such date or the date upon which the City Council takes final action upon the recommendation of the Planning Board with regard to its review of ECDC Chapter 20.21, whichever shall first occur.
