RESOLUTION NO. 652
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
- EDMONDS, WASHINGTON, INITIATING THE VACATION
OF THE DEDICATED BY UNBUILT RIGHT OF WAY OF
78TH AVENUE WEST AND REFERRING SAID VACATION
FOR HEARING EXAMINER REVIEW
WHEREAS, the City is the owner of a portion of the dedicated
but unbuilt right -of -way of 78th Avenue West, and
WHEREAS, 30 feet of said unbuilt right -of -way was dedicated
as a condition of the approval of short subdivision 5 -56 -79 in
order to comply with the City's right -of -way requirements as
expressed in its Master Street Plan, and
WHEREAS, the City has amended the official street map in
action - - -85 to reduce the proposed street right -of -way for 78th
between 236th and 238th St. S.W.
Avenue We t1from 60 to 40 feet thereby obviating the need for 20
feet of said prior dedication.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. In conformance with the provisions of Chapter
20.70 Street Vacations of the Edmonds Community Development Code,
the vacation of a portion of the unbuilt right -of -way of 78th
Avenue West is shown and further described on attached Exhibit A,
said description being incorporated by this reference as fully as
if herein set forth, is hereby initiated by this resolution of the
City Council.

Section 2. In conformance with the provisions of said
chapter, this proposed vacation is hereby referred to the Hearing
Examiner of the City of Edmonds for his /her review and
recommendation in conformance with the provisions of the said
chapter. The hearing examiner is directed to return his /her
recommendations to the City at the hearing examiner's earliest
convenience.
