RESOLUTION NO. 654
A RESOLUTION OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING THE FINAL ASSESSMENT ROLL OF LID 212
BY THE CORRECTION OF THE ASSESSMENTS AGAINST
PARCEL 7, TO CONFIRM IT WITH RESPECT.TO LOT 2
OF SUBDIVISION S -28 -85
WHEREAS, the City of Edmonds has confirmed the final
assessment roll of LID 212, and
WHEREAS, the assessment levied against parcel 7 was
improperly assessed against the wrong lot created by subdivision
5 -28 -85 and should properly have been levied against Lot 2 of
said subdivision, and
WHEREAS, said subdivision has occurred prior to the
date of preparation of the final assessment roll and that the
failure to properly assess said parcel was through no fault of
the applicant. The Council therefore finds that it is not
appropriate to require as a condition of this order that
applicant pay to the City any reasonable engineering or clerical
costs incident to making the correction, and
WHEREAS, the City Council finds that such correction
will not impair the security of the lien for such assessment nor
reduce the security for any outstanding local improvement
district obligations payable from such assessment, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The City Council hereby orders the City
Clerk and Finance Director to correct on final assessment roll of
LID 212 the assessments shown against Parcel 7 by levying the
assessment for Parcel 7 against Lot 2 of the subdivision S- 28 -85,
as approved by this Council.
Section 2. In all other respects the final assessment
roll of LID 212 is hereby confirmed and shall remain in full
force and effect.
