RESOLUTION NO. 595
A RESOLUTION OF THE CITY OF EDMONDS, WASHING-
TON, EXERCISING AN ELECTION FOR EMPLOYER
PAYMENT OF RETIREMENT CONTRIBUTIONS UNDER THE
PROVISIONS OF SHB 4477 AND INSTRUCTING THE CITY
CLERK TO NOTIFY THE APPROPRIATE STATE
AUTHORITY.
WHEREAS, SHB 4477 authorizes an election by cities to
make employee contributions directly to the state retirement
systems, thereby reducing gross income only for the purposes
of federal income taxation;
WHEREAS, such an election would provide income tax and
other economic benefits to City employees without incurring
any cost to the City;
WHEREAS, City employees have been notified of the
effects of an election under SHB 4477 and have indicated that
a majority favor such an election, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section_l. The City Council of the City of Edmonds
hereby elects to exercise its option to implement employer
payment of all member contributions for its employees as a
form of deferred compensation subject to the terms and condi-
tions of SHB 4477 and RCW 41.04. This election shall be
effective as to all members of the Law Enforcement Officers'
and Fire Fighters' Retirement System (LEOFF) under RCW
41.26.080(1) and 41.26.450 and the Public Employees' Retire-
ment System (PERS) under RCW 41.40.330(1) and 41.40.650.
Section 2. Should the Washington State Legislature
revoke any benefit permitted under the provisions of SHB 4477
or should the City of Edmonds by its council for any reason
exercise its option under Section 3, paragraph (2) to withdraw
from this deferred benefit program, no affected employee shall
be entitled to receive such benefit as a matter of contractual
right.
Section 3. The City Clerk is hereby authorized to
forward a certified copy of this resolution along with any
other information prepared by the City staff required to
accomplish this election to the Washington State Department of
Retirement Systems.
