Resolution 534a RESOLUTION NO. 534 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON SETTING A NEW HEARING DATE ON THE PRELIMINARY ASSESS - MENT.ROL'L'FOR L.I.D.. No. 209; AUTHORIZING AND DIRECTING THE CITY CLERK TO SEND NOTICES AS REQUIRED BY LAW. WHEREAS, pursuant to Resolution No. 258 passed by the City Council on January 13, 1981, the City Council of the City of Edmonds held a public hearing on March 3, 1981 to consider formation of an L.I.D. for the improvement of Cyprus Place in the City of Edmonds, and WHEREAS, said hearing was held and after said hear- ing the City Council enacted.Ordinance No. 2200 on March 3, 1981 creating L.I.D. No. 209, and WHEREAS, subsequent to the creation of said district the City has called for bids for construction of the improvement and said bids have been returned, and WHEREAS, it appears that the low bidder for the project has bid a cost more than 25% in excess of the estimated costs of the improvement as reflected on the preliminary assessment roll:, and WHEREAS, the City Council deems it expedient and advisable to afford the property owners additional oppor- tunity to voice their opinions on the formation of the L.I.D. now, therefore, -1- 1 i THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. It is the intention of the City Council of the City of Edmonds, Washington, to improve certain property as hereinafter set forth in the City of Edmonds, by paving the street with an asphalt overlay, installing a water line, installing necessary drainage and performing any necessary grading or base preparation and related work necessary to make a complete improvement in accordance with City standards, said street being an extension of Cyprus Place as set forth on Exhibit "A" attached hereto and incor- porated in full by this reference. Section 2. That the cost and expense of all labor and material required to make a complete improvement, in- cluding legal, engineering, administrative, printing, cost of acquisition, and all other expense of every kind, shall be made by special assessment; a local improvement district shall be established embracing as near as may be, all the property that shall be specially benefited by said improve- ment and such specially benefited property shall be assessed to pay the entire cost of said improvement under the mode of payment by bonds in accordance with the zone- and - termini method of assessment or other method of assessment as authorized by law. Section 3. All persons who may desire to object to the improvement herein mentioned are hereby notified to -2- appear at the City Council Chambers in the Civic Center in the City of Edmonds? Washington, at a meeting of said Council, on the lst day of November, 1982, at the hour of 7:30 p.m. of said day, then and there to present their objections thereto if any they have. Section 4. The City Engineer of the City of Edmonds, is hereby directed to submit to the City Council at or prior to such day and time the estimated cost and expense of the improvement identified in this Resolution and a statement of the aggregate valuation of the real estate and twenty -five percent (250) of the actual valuation of the improvement thereon within the said proposed improvement district, according to the valuation last placed upon it for general taxation, to with a diagram or print showing thereon the lots, tracts or. parcels of land or other property which shall be specially benefited thereby, and the estimated amount of the cost and expense of such improvement to be borne by such lot, tract, parcel of land or other property. -3- Section 5.
