Resolution 431RESOLUTION NO. 431 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 1 OF RESO- LUTION NO. 428, PASSED BY THE CITY COUNCIL ON FEBRUARY 27, 1979, TO ALLOW CITY DEPARTMENTS AND OFFICIALS TO ISSUE BUILDING PERMITS FOR CONSTRUC- TION OTHER THAN CREATION OF AN ADDITIONAL DWELLING UNIT IN THE MEADO,WDALE AREA OF EDMONDS. WHEREAS, the City Council on February 27, 1979, enacted Resolution No. 428 which imposed a moratorium on issuance of all building permits and approvals of planned residential developments, subdivisions and short subdivisions in the Meadowdale area of Edmonds, and WHEREAS, said moratorium was necessary and in the best interest of the public health, safety and general welfare because of the high potential for landslides in the area due to the steep slopes, sand and clay soil formations and the quantities of ground water percolating through the soil due to the lack of storm and sanitary sewers, and WHEREAS, said Resolution imposed a moratorium on issuance of all building permits, including permits for such structures as decks, remodeling, and other buildings and structures which do not appreciably add to the level of ground water, and WHEREAS, construction which does appreciably affect the quantity of ground water and the soil stability in the area is construction adding additional dwelling units -1- to the area, and WHEREAS, Resolution No. 428 prohibited the City staff from processing or issuing permits for any construction and there is a need to provide for exceptions which will not add to the problems in the area and thus will not cause a danger to the public health, welfare and safety, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section l of Resolution No. 428 passed by the City Council on February 27, 1979, is hereby amended to read as follows: "Section 1. No City Department or official shall issue, approve or process an application for any building permit or application for approval of a planned residential development, subdivision or short subdivision which has been filed with the City on or after February 27, 1979, for that area commonly known as the Meadowdale area, located generally north of 168th Street Southwest and more particularly depicted on the map which is labeled Exhibit "A" attached to this Resolution, and incorporated in full by this reference, until the study authorized hereinafter is completed and remedial action is enacted; provided, however, this Section shall not apply to building permits for construction which does not add an additional dwelling unit or units to those existing prior to February 27, 1979."
