A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, REPEALING RESOLUTION NO. 328,
PASSED BY THE CITY COUNCIL ON MAY 20, 1975.AND
RESOLUTION NO. 334, PASSED BY THE CITY COUNCIL ON
JULY 15, 1975 AND DECLARING THE INTENTION OF THE
CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
TO IMPROVE CERTAIN PROPERTY IN SAID CITY BY
CONSTRUCTING CONCRETE SIDEWALKS, RETAINING WALLS
OR ROCKERY, NECESSARY GRADING AND BASE PREPARATION
AND RELATED WORK NECESSARY TO MAKE A COMPLETE
IMPROVEMENT IN ACCORDANCE WITH CITY STANDARDS;
CREATING A SIDEWALK CONSTRUCTION FUND THEREFOR;
PROVIDING THAT PAYMENT OF COSTS OF SAID IMPROVE-
MENT BE MADE BY SPECIAL ASSESSMENT ON THE SPECIALLY
BENEFITED PROPERTY ABUTTING SAID IMPROVEMENT,
BASED ON SPECIAL BENEFITS; AND ESTABLISHING A
HEARING DATE.
WHEREAS, the City Council by Resolution No. 328,
passed by the City Council on May 20, 1975 and Resolution
No. 334, passed by the City Council on July 15, 1975, authorized
construction of sidewalks on 5th Avenue South from Main
Street to State Route 104, and
WHEREAS, since that time the property owners have
developed sidewalks on 5th Avenue South and therefore the
sidewalk improvement district as originally contemplated is
no longer necessary, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. Resolution No. 328, passed by the City
Council on May 20, 1975 and Resolution No. 334, passed by

the City Council on July 15, 1975 are hereby repealed.
Section 2. It is the intention of the City Council
of the City of Edmonds, Washington, to order the construction
of sidewalks and driveways across sidewalks, retaining walls
or rockeries, necessary grading and base preparation and
related work necessary to make a complete improvement in
accordance with City standards on both sides of 5th Avenue
South from Walnut Street to and including the intersection
of the northerly right -of -way line of State Route 104.
Section 3. The City shall bear the costs of removing
existing deteriorated sidewalks, preparing the base and placing
required fill and constructing necessary rockeries. The abutting
property owners shall bear all other costs necessary to make a
complete improvement in accordance with City standards.
Section 4. A sidewalk construction fund shall be
created and the specially benefited abutting property shall
be assessed to pay the portion of costs of such improvements
as set forth in Section 3, in one payment or in installments
at the election of the specially benefited abutting property
owner, the times, amounts and interest on said unpaid install-
ment, if any, to be hereafter determined.
Section 5. All persons who may desire to appear
for or against said improvement herein mentioned are hereby
notified to appear at the Council chambers in the Civic
Center in the City of Edmonds, Washington, on the 26th day of

JUNE , 1979, at the hour of 7:30 p.m. of said day, then
and there to present their arguments for or against said
improvement, if any they have.
