RESOLUTION NO. 417
A RESOLUTION OF THE CITY OF EDMONDS, WASHINGTON,
CONTINUING A MORATORIUM ON ISSUANCE OF BUILDING
PERMITS IN THE WATERFRONT COMMERCIAL (CW) ZONING
CLASSIFICATION SOUTH OF MAIN STREET AS PREVIOUSLY
IMPOSED BY RESOLUTION NO. 394, PASSED BY THE CITY
COUNCIL ON FEBRUARY 28, 1978 AND AS CONTINUED BY
RESOLUTION NO. 413 PASSED BY THE CITY COUNCIL ON
SEPTEMBER 12, 1978.
WHEREAS, the City Council of the City of Edmonds,
Washington, by Resolution No. 394, passed on February 28,
1978, and by Resolution No. 413, passed on September 12,
1978, found and declared that certain unforseen and unpre-
dicted development threatened to adversely impact the existing
and future building, zoning and planning regulations in the
CW zone south of Main Street, and
WHEREAS, by said Resolutions, the City Council
imposed a moratorium on issuance of all building permits in
the CW zone, south of Main Street, and
WHEREAS, pursuant to said Resolutions, the City
staff has completed its studies and investigations into pro-
posed changes in the Edmonds Shorelines Master Program, the
Edmonds Policy Plan and the Edmonds Zoning Code with respect
to the CW zone, and
WHEREAS, the City Planning. Commission and the City
Council have held hearings regarding certain proposed amend-
ments and,
WHEREAS, the City Council has directed the City

Attorneys' Office to prepare the necessary ordinances amending
the Edmonds Policy Plan and the Edmonds Zoning Code relating
to development in the CW zone which are scheduled for Council
consideration on November 7, 1978, and which if adopted at
that time will not be effective until November 13, 1978, and
ordered that the moratorium be continued in effect until
November 7, 1978, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The facts and circumstances forming
the basis for the adoption of the findings and conclusions
contained in Resolution No. 394, passed by the City Council
on February 28, 1978, with respect to the declaration of
emergency and the necessity of imposing a moratorium on
issuance of all building permits in the CW zone are still in
existance.
Section 2. In order to afford the City Council an
opportunity to consider certain proposed changes in the
Edmonds Policy Plan and the Edmonds Zoning Code with respect
to the CW Zone, the moratorium on issuance of all building
permits in the CW zone south of Main Street, previously
imposed by Resolution No. 394 and continued by Resolution
No. 413 shall be further continued in full force and effect
until the effective date of any ordinance adopting new..regu-
lations or November 15, 1978, whichever first occurs.
Section 3. The building division of the City of
Edmonds will issue no building permits for new structures,
rebuilding and /or remodeling of existing structures which

exceed 15% of the fair market value of any such existing
structure in the CW zone prior to the expiration of this
moratorium.
Section 4. The City Council shall review the
continuation or expiration of this moratorium at its regular
meeting on November 14, 1978.
