A RESOLUTION OF THE CITY OF EDMONDS, WASHINGTON,
CONTINUING A MORATORIUM ON ISSUANCE OF BUILDING
PERMITS IN THE WATERFRONT COMMERCIAL (CW) ZONING
CLASSIFICATION SOUTH OF MAIN STREET AS PREVIOUSLY
IMPOSED BY RESOLUTION NO. 394, PASSED BY THE CITY
COUNCIL ON FEBRUARY 28, 1978.
WHEREAS, the City Council of the City of Edmonds,
Washington, by Resolution No. 394, passed on February 28,
1978, found and declared that certain unforeseen and un-
predicted development threatened to adversely impact the
existing and future building, zoning and planning regulations
in the CW zone south of Main Street, and
WHEREAS, by said Resolution the City Council
imposed a moratorium on issuance of all building permits in
the CW zone, south of Main Street, for a period of at least
six months from the effective date of said Resolution, and
WHEREAS, the City Planning Division, the Shoreline
Management Citizens Advisory Committee and other departments
of the City have held meetings, conducted studies and made
recommendations for certain changes to the Edmonds Shorelines
Master Program, the Edmonds Policy Plan and the Edmonds
Zoning Code relating to development in the CW zone, and
WHEREAS, pursuant to duly published and posted
notice, the Edmonds Planning Commission held a public hearing
on August 23, 1978, to consider these proposed changes and
at the conclusion of said hearing, approved Planning Commission
Resolution No. 600 which was forwarded to the City Council and
contained certain recommendations for amendments to the
Edmonds Shorelines Master Program, the Edmonds Policy Plan
and the Edmonds Zoning Code relating to development in the
CW zone, and
WHEREAS, pursuant to said Planning Commission
Resolution No. 600, the City Council held a public hearing
on September 5, 1978, to.consider the proposed amendments,
and at such meeting, testimony from the public was received
and substantial discussion occurred regarding the recommendations
contained in Planning Commission Resolution No. 600, and
WHEREAS, at the conclusion of said public hearing,
the City Council found that many of the alternatives proposed
should be more fully considered in light of the critical
environmental sensitivity of the CW zone and that the
City Council needed additional time to adequately analyze
the proposals, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVE AS FOLLOWS:
1. The facts and circumstances forming the basis
for the adoption of the findings and conclusions contained
in Resolution No. 394, passed by the City Council on Feburary
28, 1978, with respect to the declaration of an emergency
and the necessity of imposing a moratorium on issuance of
all building permits in the CW zone are still in existance;
2. In order to afford the City Staff, various
City boards, commissions, City Council and the general
public with additional time to consider the proposed changes

in the Edmonds Shoreline Master Program, the Edmonds Policy
Plan and the Edmonds Zoning Code with respect to the CW
zone, the moratorium on issuance of all building permits in
the CW zone south of Main Street, previously imposed by
Resolution No. 394, shall continue in full force and effect
until at least October 31, 1978.
3. The Building Division of the City of Edmonds
will issue no building permit for new structures, rebuilding
and /or remodelling of existing structures which exceed
fifteen percent (150) of the fair market value of any such
existing structure.
4. The City Council shall review the continuation
or expiration of this moratorium at its regular meeting on
October 31, 1978.
