A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, TRANSFERRING THE SUM OF
ONE THOUSAND SIX HUNDRED NINE AND 80/100 DOLLARS
FROM THE CONTINGENCY FUND NO. 119 TO THE GENERAL
FUND NO. 001 FOR PAYMENT OF FEES OF ATTORNEYS
APPOINTED FOR INDIGENT DEFENDANTS
WHEREAS, the Supreme Court of the United States of
America through a decision rendered by said Court required
the appointment of counsel for indigent defendants where
loss of liberty could occur as a result of a conviction for
violation of a criminal statute or ordinance, and
WHEREAS, there was no provision either by said Court
decision or by existing State law setting forth the legal
obligation of the City to pay for said services, and
WHEREAS, subsequent to the decision of the United States
Supreme Court the State Legislature of the State of Washington
enacted certain legislation clarifying the responsibility and
obligation of the City to pay for said services but leaving
unanswered the question of responsibility in the time period
between the issuance of the United States Supreme Court opinion
and the State Legislation, and
WHEREAS, litigation was instituted naming the Cities of
Lynnwood, Mountlake Terrace, Edmonds and Snohomish County as
party defendants in order to determine the obligation for
payment of said funds, and
WHEREAS, said litigation was resolved and a judgment
entered on September 15, 1975, requiring the City of Edmonds
to pay its pro rata share of said expenses, and
WHEREAS, said sums could not reasonably foreseen as
being an obligation which would be payable by the City at the
time of budget deliberations for the fiscal year 1975, now,
therefore,
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, AS FOLLOWS:
Section I. There is hereby transferred from Contingency
Fund No...119 to the General Fund No. 001 the sum of One
Thousand Six Hundred Nine and 80/100 Dollars ($1,609.80) to
be used for satisfaction of the judgment entered in that
certain lawsuit filed in Snohomish County Superior Court
entitled Bennett A. Box, et al vs. City of Edmonds, Snohomish
County Cause No. 123825.
Section 2. The Finance Director is hereby instructed to
make the necessary transfer pursuant to Section. l of this
Resolution.
