A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS,
WASHINGTON, TRANSFERRI14G THE SUM OF FOUR THOUSAND FIVE
HUNDRED THIRTY AND N01100 DOLLARS FROM THE CONTINGENCY
FUND NO. 119 TO THE.GENERAL FUND NO. 001. DEPARTMENT 34
FOR BICENTENNIAL CELEBRATION PURPOSES AND THE SUM OF
SIX HUNDRED SEVENTY -FIVE AND 45/100 DOLLARS FROM.THE
CONTINGENCY FUND NO. 199 TO THE CENTRAL FUND NO. 001
DEPARTMENT 16 "TO PAY ATTORNEYS'. FEES FOR INDIGENT
DEFENDANTS.
WHEREAS, the City of Edmonds has been designated as a
Bicentennial City by the American Revolution Bicentennial
Administration, and
WHEREAS, such designation took place in the latter part
of December, 1974, after finalization of the City Budget for
the year 1975, and
WHEREAS, it is in the interest of the public that some
planning be accomplished during the year 1975 with respect
to the city celebration of the bicentennial birth of this nation,
and
WHEREAS, the Supreme Court of the United States of America
through a decision rendered by said Court required the appoint-
ment of counsel for indigent defendants where loss of liberty
could occur as a result of a conviction for violation of a
criminal statue or ordinance, and
WHEREAS, there was no provision either by said Court
decision or by existing State law setting forth the legal
obligation of the City to pay for said services, and
WHEREAS, subsequent to the decision of the United Sates
Supreme Court the State Legislature of the State of Washington
enacted certain legislation clarifying the responsibility and
obligation of the City to pay for said services but leaving
unanswered the question of responsibility in the time period
between the issuance of the United States Supreme Court opinion
and the State Legislation, and
WHEREAS, said sums could not reasonably be foreseen as
being an obligation which would be payable by the City at the
time of budget deliberations.for the fiscal year 1975, now,
therefore,
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, AS FOLLOWS:
Section 1. There is hereby transferred the sum of $4,180.00
from the Contingency Fund No. 119 to the General Fund No. 001
Department 34 for the purpose of the 1776 -1976 bicentennial
celebration for relocation and preservation of the historical
log cabin.
Section 2. There is hereby transferred the sum of $3.50.00
from the Contingency Fund No. 119 to the General Fund No. 001
Department 34 for the purpose of preservation of the early
history of the City of Edmonds.
Section 3. There is hereby transferred the sum of $675.45
from the Contingency Fund No. 119 to the General Fund No. 001
Department 16 for the purpose of payment for attorneys fees for
indigent defendants.
Section 4. The Finance Director is hereby instructed to
make the necessary transfer pursuant to Sections 1, 2, and 3
of this Resolution.
