Resolution 045 ARESOLUTION 10.45. Whereas, the City of Ediionds has, for a period of more than twer_ty (20) years last past, asserted title to that portion of Main Street in said City of Edmonds, lying between the right-of- way of the Great Forthern Railway Compary and the tide land lot to the West of the sauce, which title is based upon a condemnation suit instituted by the Town of Edmonds, February 14, 1899, in which a Decree of User was obtained and a Decree of Judgment entered or February 10,1905 and upon open, notorious and continu- ous use of said Street between the date of said condemnation pro- ceedings and the present time, and Whereas, the City of Edmonds is now using said part of Main Street as a public Street and has leased the end thereof to the Sound Ferry Lines, Inc., which Compary has constructed thereon a substantial ferry dock, extending from the er_d of said Street ouJI through the tide lard lot in front thereof into the harbor area and is operating from said dock a ferry line from Edmonds to Kingston which connects with another line across Hoods Canal to the Olympic Peninsula, and is about to commence operating a second ferry line from said dock to Port Ludlow on said Olympic Penin- sula, and . Whereas, some title or interest is being asserted by the �QGr`� Crosby Ferry Lines, Inc., to that portion of Main Street in said City of Edmonds between the main_ lire of the Great T orthern Rail-/ way and the tide land lot in front thereof and the said Crosby Ferry Lines, Inc., has made application to the Commissioner of Public Lands of the State of Washington for the purchase of that certain tide land lot in front of the City of Edmonds included between the forth and South lines of Main Street extended, and, �- Whereas, it is to the interest of the people of the City of Edmonds that Main Street be kept oper and mairtaired as a public.��'' thoroughfare from said right-of-way of the Great Northern Rail- way Company Westerly across the upland lot and through the tide lands in front thereof to the harbor area, and, Whereas, it is the determination of the City Council of the ��,�,�i City of Edmonds to maintain the same as a public thoroughfare to be dedicated to the irterest of the people of the City of Edmonds perpetually and if for any reason the title to that part of the upland lyirg within the corfines of Main Street extended should for any reason be held to be defective, to recondemr, said pro- perty as a public thoroughfare and part of Main Street of the City of Edmonds, now therefore, ' Be it resolved by the City Council of the City of Edmonds: QThat it doe's hereby protest.to Clark Savidge, the Commissioner of Public Lands of the State of Washington, against the sale by the State of Washington to the Crosby Ferry Lires, Inc:; -or - to any other private individual or Company of that said tide land lot lying in front of Main Street in the City of Edmonds, either now or at any other time, and particularly requests that any proposed or contemplated sale of said tide land lot be held in abeyance until such time as title to that part of Main Street lying West of the Great lortherr, Railway Company in the City of Edmonds be settled and determined.
